Will OIG Bust J Thomas Burch Jr, A Special Forces Phony?

An investigation by Military Phonies into the Special Forces service of J Thomas Burch Jr revealed he was not a Green Beret in Vietnam; he was merely in the unit working as a JAG attorney.

On the website of the National Vietnam Veterans Foundation, president J Thomas Burch Jr claims to be a Green Beret. For decades, he has been seen wearing his green beret for award ceremonies and other events. But he was not an operator and was not an actual Green Beret, at least in the way people normally think.

Instead, Military Phonies uncovered that the fundraiser and high-ranking VA attorney likely misled the public about his military service history claiming he was a Green Beret despite no official military records showing he was a fully trained Green Beret working in that capacity. He then used that misrepresentation to raise money for his low rated foundation.

Maybe he was the Green Beret of papercuts working as a JAG attorney in Vietnam?

According to a document from the executive director of Special Forces Association, Burch was:

“eligible for an Associate membership. For some reason, the folks in charge here gave him a general and later Decade membership. It is going to get ugly for this guy.”

Military Phones found that Burch was a JAG officer when he was serving within an Army’s Special Forces unit. I guess this would make him support staff. Burch’s only advanced military training, related to Special Forces, was jump school, but that certainly does not make him an operator of the Green Berets worthy of wearing that cover.

Does that make Burch a Green Beret? Did he earn the right to wear this beret around for the next 40 years at fundraisers?

These revelations mean J Thomas Burch Jr was no more “Special Forces” than VA Secretary Robert McDonald. Both were linked with “Special Forces” and received some a small amount of training, but neither earned the right to call themselves “Special Forces.”

About the Green Beret claim, Military Phonies concluded, “J Thomas Burch Jr’s military claims are not supported by his official military records.”

MY ‘SPECIAL FORCES’ BACKGROUND

Personally, I served in the Special Forces, too.

I was a radio mechanic who worked on aircraft. But, you will not see me walking around with a USAF Combat Control beret or Pararescue beret because I did not earn it. Those individuals are known as “operators.” I was a mechanic.

Now, I did receive the marksman ribbon, but that would not make me a Sniper no more than participating in jump school makes Burch a Green Beret.

This seems simple right? I still very proudly tell people that I served in the Special Forces, but I will not lie and tell people I was a Green Beret.

That would be silly and I have nothing to compensate for to justify deceiving people. Yeah, I am sure people would think I am even cooler if I was an operator like a Seal, but I do not need to bolster my reputation by lying.

OTHER J THOMAS BURCH JR INVESTIGATIONS

This is not the first time Burch was called out in the media this month.

A CNN investigation revealed Burch runs one of the worst rated veterans foundations called the National Vietnam Veterans Foundation (NVVF). The news agency found this ironic since Burch is also a VA employee.

Only $122,000 of the $8.5 million in funds raised for the organization went directly to veterans, which is a slap in the face and misuse of sentiment for veterans.

My investigation into Burch last week revealed that he is also a high-ranking VA attorney within the Office of General Counsel (OGC). Burch is in charge of OGC’s Freedom of Information Act program. He is also the VA Deputy Director of Homeland Security & Operations.

I also uncovered that NVVF uses robo-callers and professional solicitors at companies with shady histories that included prosecutions for fraudulent practices in the majority of states.

The foundation also raises funds under various other organization names it uses as trade names.

VA OIG is supposedly investigating this VA attorney.

I just had one of my severely disabled veteran clients tell me Burch’s foundation just called him to raise funds. He said the caller seemed suspicious.

When will VA shut this operation down?

  1. Don’t hold your breath with OIG.

    I am a retired police officer and spent approximately 6 months researching a military phony who is a very successful author. Through the FOIA, I was able to document he was never a captain, never an aviator, never earned 3 purple hearts, never earned the Navy Cross, and not shot down over the sky of Hanoi and in a firefight with a Marine Unit. He touted all these achievements so as to appear as a combat veteran so real combat veterans would open up to him. He wrote books ~ he made money ~ he serves in local politics and cited his military background while campaigning. Was OIG interested? Nope. I asked for an explanation ~ none given.

    Then again, your Mr. Burch is far more “high profile,” so maybe there is hope…

    1. One additional item on my subject: He had the VA Medical Center provide me with a copy of his DD-214. I had the NARA do a side by side comparison and either the NARA and checked with the Navy Awards Section, and either they have omitted 99.9% of listed awards and done my subject a severe disservice, or, my subject created his own DD-214 and gave it to the VA Medical Center for treatment.

  2. As of today, Burch has been disavowed by the same Veterans Foundation he started, and the foundation is completely shutting down because of the way it was run… There’s a story on CNN… Thought you guys would like to know.

  4. TSA trying. When I traveled overseas several years back in California stopped at a little store to buy a bottle of water to drink on the plane. TSA guard saw me walk in the store and out. When I approached him -you can’t take that on the plane even though he saw me drinking from it. Yet a few mintues later he let a woman with a carry on bag that was opened and you could clearly see the unopened water bottle .So explained that???

    Thank You for not letting this story drop from the headlines. Most certainly when they break out Robbie McDonald playing Goofy and Disneyland you know that they want a story to go away. This might be the one.

    The further I dig into Thomas Burch the more it looks like in fact the multiple foundations he is running are slush funds set up to receive bribe money on bids for government contracts. The sources for these donations that add up to $29 million over the last 4 years and nobody has heard of these organizations doing business in the last 4 years.

    Except companies like Astrophysics Inc. a Multi-Million-dollar contractor doing business with the Veterans Administration and Homeland Security.

    A company where Thomas Burch’s Grand-daughter Hallie Powell worked while she was also working with Grand-Dad at the VA in the Office of General Counsel. Also while working at the VA she Like Grand-Dad she was connected to multiple Foundations as Executive Director of National Vietnam Veterans Foundation, Executive Director of American Veteran Support Foundation, and also employed as an independent coach at Team Beachbody. But Gram-pa didn’t work at Team Beachbody.

    Although I should mention that she did leave Astrophysics Inc. to take over as Executive Director at the Foundations. Also worth mentioning her position at the VA was terminated as soon as CNN started investigating Thomas Burch.

    In her LinkedIn profile she does list some stellar qualification such as she was able to arrange luncheon for 15 visiting competitors. Also her special training by the US Department of Justice on handling FOIA requests.

    PS for anyone traveling this week end and caught in a long line at the TSA or got stuck on one of those flights were your baggage didn’t make the same flight you did do to equipment failure. Know that in government contracting it is no longer who you know but how big your bribe is to get a contract.

    Also know that the Department of Transportation IG report shows that in 95% of the cases where they were testing security, the agent smuggling weapons, were able to get the fake bombs and guns aboard the aircraft. I guess that means you are 5% more secure.

I go to the VAMC regularly I have read on this website the word “disruptive behavior” would someone explain to me if this is a Federal Charge for being rude to VA personnel or employee’s being rude to there supervisors. Because I seen a lot veterans being rude to personnel, as well as employee’s to there boss. What I asking is this a physical charge where you are written up and have to appear at some type of trial.

    1. The disruptive committee is a committee that the VA uses as a retaliation to veterans whom they feel can be or could be disruptive.

      The OIG. States VA can not even define what constitutes disruptive behavior.

      Yet an employee can claim at anytime that a veteran had been disruptive and the committee will punish the veterans.

      This committee act’s like a judiciary component of our legal system.

      This committee is an illegal judiciary component of the VA.

      They punish veterans and employees are not required to provide proof of the disruptive behavior.

      Veterans are not given anyway of fighting back to clear their good name. They don’t give you a ticket where you can go in front of a judge.

      They are the accuser. Judge. Jury and punisher and the veterans have no way of defending themselves.

      I had an employee tell the committee that. I would come into my local clinic at least twice a month and become disruptive.

      Do not know how many month’s this was to have happened. But I know that employees are required per regulations to document any disruptive behavior.

      I know I never ever been disruptive. So I requested all the reports of me being disruptive.

      VA. Well there is no evidence. But has been collaborated. ? Oh yea by whom. Would not tell me !

      Vamc Denver director told senator Bennett’s office That due to the disruptive behavior reporting NOTHING was ever done to James and his records were never coded for disruptive behavior.

      Nor were his records ever red flagged and they never did any investigation.

      The chief of staff. Let the very same employee accusing me of disruptive behavior answer any and all correspondence herself. She would never admit she was lieing.

      The only reason she reported me. Is because I use to work for the VA and the director. Made me the Hispanic coordinator and this pissed her off.

      After I retired they made her lead administrator of my local clinic and the hate she held against me. Let her to retaliate against me.

      I live 2 block’s from the VA clinic. Due to her lieing and the committee not requiring written proof. I was forced to travel 120 miles round trip for five year’s.

      To top it off. The chief of staff in Denver. Wrote into my official medical records. That if ever hear of me being disruptive again.

      You will have federal charges placed upon you and you will be arrested and you will be banished from all VA care.

      How’s that for an injustice. Veterans are accused everyday and the VA is falsely accusing many.

      They should not be allowed to use this committee to punish veterans.

      If someone becomes disruptive. That’s a matter for the local police and our legal justice system. Where a person could fight back and obtain legal council.

      All involved in this I justice should be removed and federal charges placed upon them.

      Truth and nothing but the truth !

  8. Burch IS NOT Airborne Qualified.. No Airborne Tab.. No Jump School.. Nothing in his NPRC records say anything about him being Airborne..

    He was awarded a “Vietnamese HONORARY Parachutist Certificate”, by a Major General Doan Van Quang of the South Vietnamese Military.. This is in his records.. But an HONORARY Certificate is a far cry from being Airborne Qualified.. … ..

      Took me 40 year’s and only after hiring an attorney.

      I ask because once I became service connected and seen a report from the rater. Stating James was shot in the head and taken to a German hospital and then to an American hospital.

      I do not remember these hospital’s and would like to see it in writing.

      I know I was shot in the head. But VA state’s. I was hit in the head with a tear gas canister.

  9. As a lawyer, Ben, does the VA have the power to ‘shut down’ a private 501c3?
    I agree that the guy is an embarrassment and more, but what does this have to do with the legality of his job description and work performance? How can the VA summarily dismiss him simply for being an asshat?

    1. The only agency that could shut down his 501c3 is the IRS, but given the years the NVVF has had that status, they would have to have substantial reason for doing so. The VA cannot do anything against the status of the organization.

      Doing a search on “Ethics for federal employees” shows a number of links to what agencies do regarding the conduct of their employees.

      If you look at the 14 principles of ethical conduct for federal employees as spelled out in Executive Order 12674, #10 says, “Employees shall not engage in outside employment or activities – including seeking or negotiating for employment – that conflict with official Government duties and responsibilities.”

      What the VA CAN do is follow the law, Executive Orders, policies or directives that govern ethical conduct by federal employees.

      It might be the first time the VA would ever be known to have done so.

      As a federal employee, if he were a computer specialist, he can perform his duties, and be involved with a homeless charity, food shelter or some other similar charity and likely not be in violation of any ethics issues. Now, if he were a computer specialist and was the head of a non-profit that advocated some government program to give away free computers, it still may not be unethical, but the agency OGC would likely require his work duties and his charitable duties to be reviewed for any possible conflict. Depending on his level of rank within an agency, many would require a review no matter what his charitable work would be.

      Given he is an attorney within a federal agencies OGC, the ethical thing to do would be for his ethics review to be conducted outside the agency, and likely at a higher level…if for nothing else than to provide he or the agency leadership cover by being able to point at that review and say, nothing was found.

      Given he is an attorney in an agency whose mission is supposedly to administer benefits for veterans, and he is the paid head of a “charity” for veterans and raising money supposedly to help veterans, I would be shocked if no attorney in the OGC did not suggest his outside work needed review.

      I have known some who have required OGC review for outside VOLUNTEER work.

      Would it surprise me if no review took place at all? Absolutely not. There is no such thing as ethics in VA HQ.

      Will anything happen to him? I highly doubt it other than they do some kind of window dressing review, suggest it doesn’t look good, and he resign from one or the other jobs.

      The only way anything happens to Burch is if some other attorney raises a huge stink if they find some funny business with his fundraising, and that stink would likely have to be raised to an outside entity like a bar association or something.

      I would like to know how long he has been working for the VA as an attorney, and how long he has been doing anything with the NVVF. That nobody has raised significant questions about his work for a veterans charity with such a pathetic charity score shows how little ethics are practiced by anyone in the VA OGC.

  11. Well, at least he got himself Airborne qualified. Can’t say he did anything else, except getting “assigned” to a Special Forces unit instead of getting put in one. I run into “wannabes” all the time. Just the other day at the VAMC I saw a man wearing a Viet-Nam veteran hat and I asked where he was at in Viet-Nam and he said he was all over Viet-Nam. I then asked him where were some of the places that he went to over there, and he expressed to me again he was all over Viet-Nam. I quickly dropped the subject. I could tell he was never over there and I walked away. I didn’t want to cause any further embarrassment.

    The following sentence is included, “Burch variously served as a Judge Advocate and Green Beret.”
    Among other interesting things.

    1. @crazyelf- *key word* there is “variously”, and am sure the VA or Burch has a definition for that as well, as the syntax would imply not “concurrently” or “as a Green Beret”, some real gold-plated stolen valor, but any way you cut the turd, it’s still a gold plated turd. 🙂

    2. I also like the pages of information released under the FOIA request on the link Ben Provides. Especially the listing under the heading “Transcript of Court-Martial Trial” under that heading it says “Not In File”.

      1. THAT must be one of the extra little *perks* of being in-charge of the FOIA, it’s too easy to ‘filter’ what comes in and never leaves and what the light of day never sees.
        When I saw that I thought it just must have been in a sub-folder, but am bet it was scrubbed.
        Burch has been at this for a LONG time and has survived being under scrutiny a few times in past, so he would not have made it this long in his pyramid scheme if he were not proficient at covering his a$$.

        Why anyone would lie about their service, where they were, when, what job(s) trained for, et al??         Well not certain I do note that on his record of assignments it lists “DISCHARGE per Para 5 SO 181”.

        The only webpages I can find on officers discharge codes suggest that the Para 5 may indicate that he was either removed from the Rolls of the Army for Misconduct or for Ecclesiastical Endorsement.

  13. I served on the LARC unit at Naval Station Danang. But we weren’t a rescue unit. We hauled agent orange up the Cua Viet River to Dong Ha.

    Since then I’ve had a couple of guys from Naval Station Danang make false claims about my service enhancing theirs. As in, “you remember when we did…” which never happened.

    Would be easy to go along and make false claims.

  14. Good information Ben. I believe if you keep digging, you will find Burch has a rather contentious history with VVA, trying to take over their organization, and other shady fundraising practices.
    The phony Green Beret jogs my memory pretty good. It was known in the late 1990s that he was a phony claiming to be a Green Beret.
    Gulf War veterans worked closely with VVA back then, and I recall there being problems then with Burch pulling various stunts…including trying to stack the board of the VVA if I recall correctly.
    Also, if I am recalling correctly, the VVA may already have a foundation called the VVF, founded prior to the NVVF.
    What I don’t know is how long he has been a VA attorney, and why the VA did not investigate his background more thoroughly or catch his phony claims. I recall seeing him somewhere…maybe the Memorial Day ceremony in DC in 1997, his Green Beret and suit is like a uniform or calling card used to call attention to himself.
    If you still have contacts with VCS Ben, there may be an individual who knows Burchs history well.
    Finally, I too wonder what veteran data Burch has access to, and if veterans getting a claim award after years of fighting and then getting a large back pay award suddenly start getting solicitation calls from a certain “charity”.

  15. Sadly no. The Stolen valor law was found unconstitutional by the Supreme Court and the law that was written and replaced it clearly does not make it a crime to wear fake or unearned ribbons or make fake claims.

    Sigh…I sometimes wonder what the law was enacted for then if there is no teeth in it

    1. Actually, am talking about ‘Stolen Valor’ in a ‘Street Justice by pissed-off Vets that will publicly shame a person into persecution or mind phuq to issue a warning to not do it again. Video. Etcetera.
      We Veterans made a LIFETIME Oath to defend our USA from this kind of crap as well in that, ‘enemies abroad or from within own gov’t.’…time for a huge coo, and the storm is making one hell of a dust cloud.

      So, who CARES about the Supreme Ct. on matters of Stolen Valor. A thief, Liar, Scammer, Federal Employee of several positions…this Burch is even worse than a Bernie Madoff in that the Vet’s only received interest $ on the Millions this asswipe kept for own use. I know Vets that have been waiting for prosthetics or better wheelchairs for a few years, and this ass has had his face in KFC Buckets in his Rolls living the high life….screw the Supreme Court. Stolen Valor can be taken care of by the group I alluded to. Not any freaking law.

        I wrote Denver and told them about this. They were not ?. But I am because someone could read this and keep writing what she said.

        And this could make me look like I’m lieing ! Was told to write them a letter. What was written and how it should read.

        What do they think it was I sent them (it was a letter). They said they would file it.

        U was stabbed after the military and the VA surgical team saved my life. It’s all in my.medical record.

        For the fiscal year ending 2014, they raised $8.6 million, spent $580,000 on program expenses, $270,000 on Administrative expenses, and $7.7 million in fundraising.
        The NVVF is nothing more than a fundraising pyramid scheme, with a little taken out for salaries.
        Burchs compensation is shown as $65,000 per year. How does a guy making $65 Gs afford a Rolls? Even on his VA salary?
        It makes me wonder if his Rolls was considered one of their “administrative” expenses at some point. If so, why is he using it for personal use?

A check was cashed but the ensuing gold that came from it has long been part of speculation and many Russians will tell we never paid…and that it was a lease and ruse to keep England from taking Alaska in repayment for Russia protecting New York for Lincoln from the British in the Civil War.

    1. I would really like to know who in the VAs Office of General Counsel signed off on allowing Burch to run a veterans charity and pay himself a salary. Typically a federal employee like him must get a conflict of interest waiver for any outside employment, which is generally OK as long as it does not align too closely with their official duties.

      Unless of course some “administrative” expenses were shared with others.
