Whistleblower Who Exposed Illegal Use Of Patient Restraints Wins Settlement

A whistleblower just received a settlement from VA following her reporting of unlawful use of restraints on a veteran who did not pose an imminent threat to himself or others.

In 2013, now retired nurse manager Valerie Riviello-Drew reported patient abuse at Stratton VA Medical Center. Without a doctors orders, she concluded the use of restraints was unlawful and a violation of the veteran’s rights and removed the restraints. A later investigation concluded Riviello was correct to remove the restraints.

Riviello reported one of her colleagues to a supervisor and patient safety officer.

Shortly after, Stratton VA officials demanded she step down from her position as nurse manager, a move that cut $6,000 from her pay. One year later, her attorney negotiated her reinstatement of title and pay, but she was then put into an office as a nurse educator.

By 2016, she was reportedly cut off from patient care and her colleagues began to alienate her. Documents were stolen from her computer, and typical VA corruption took its course.

Riviello eventually retired to become a teacher at a nursing school focusing on patient care, ethics, and patient advocacy. In May, she was voted Teacher of the Year.

About the settlement, Riviello said, “It feels wondering, like a weight off my shoulder.”

Of course, where there is smoke, there is fire. It’s probably safe to assume the doctor responsible for placing that veteran into restraints with improper justification likely did it to many more veterans.

Given what Stratton VA officials did to Riviello, it seems unlikely anyone else will dare do the right thing for other veterans retrained improperly.

I have been a Whistleblower on various abuse issues at the McGuire VA medical Center for years and have been subjected to various means of abuse and refused medical care along with doctors withholding vital exam results from me and making false and very damaging reports in their progress notes against me. I could write a book on abuse policies just on this hospital. I have suffered tremendously due to what cowards at the McGuire VA has subjected me too and I demand justice for a change !!! Problems are on the horizon folks ! I refuse to remain silent for cowards ! RIchmond, Virginia .

  2. Below is an example of a comment received from an email notification, but when I clicked the link to reply, the comment was gone.

    (I wont stick up for the VA but Im from the area and get my care there, hear the buzz and can tell you, this nurse actually did a diservice to the veteran. It takes a lot to use restraints and to think a doctor wasnt involved shows a mistake or lie. The new laws make it easier to get to the bottom of stuff which is great but regular workers still get to hide behind privacy so we never hear the full story of what they did. If you read the articles, they say that all her fellow employees stayed away from her after and the reporter only guesses that she did the right thing with no facts to back it up. Management dissing her Id get, but not coworkers. They usually always stick together against management, unless there’s others issues and shes doing things she shouldnt. All I know, Im glad I don’t have to get my care from her. Its also kind of odd that they put her in charge of a nurse education program which she says she hated but retires and goes into nurse education. Sounds like this story has lots of holes in it.)

    My reply…whether a VA doctor was involved or not doesn’t matter. Your comment about a doctor being involved suggests that the use of restraints was proper, but that ignores the fact that several VA doctors were involved in Phoenix and vets ended up dead.

    Hell a chief was involved at Tomah and 2 vets ended up dead.

    Having a VA doctor involved doesn’t mean squat. In fact, it should be looked on as suspicious.

    Why suspicious? Well, her firing was reversed which suggests someone substantiated that the use of restraints was wrong. Which doctor ordered the improper use of restraints?

    As for other employees staying away from her, that proves nothing other than they do not have the ethics to stand up to improper use of restraints, and do not have the ethics to stand up to unethical workplace practices. Given the blatant harrassment by management, I can bet there were also a couple staying away because they worried they too might become targets.

    As for her being assigned nurse education at the VA and her educating nurses in the civilian world…read it again and you might see the differences. Being assigned a bullshit, make-work task without resources is different than doing the same job with resources, and teaching students who actually want to learn about things like ethics.

    If co-workers knew it was an assignment designed to harrass, how interested do you think those employees would be in hearing her training?

    You do you, but I prefer receiving care from someone who can recognize and will act on a problem, not cover it up or shy away from it.

  3. Thank you Valerie Riviello-Drew, for showing some moral courage by standing up for veterans.

    It is high time for some real leadership at the VA. Leadership that speaks truth publicly about how bad things have really gotten. Leadership that develops solutions to take better care of ALL our nations warriors.

    Leadership that recognizes that when they are doing a good job – – – it will be veterans singing their praises, rather than the VA needing a PR Agency to put out “Fluff Pieces” to mislead America.

    Current VA leadership has their Brain Housing Group the size of mice and their Hearts no bigger. It is about TEN YEARS PAST TIME TO FIX THE DAMN BROKEN VA:

    1. Recognize the problems inherent in the VA are SYSTEM-WIDE, not just limited to a few locations.

    2. Fire all the Lazy No Good Workers. Fire EVERY single AFGE/SES Employee.

    3. Sell off all the VA facilities. Alternatively, they may be converted into housing for homeless veterans.

    4. Issue all veterans a card that allows them to choose their own doctors within their community that they can TRUST.

    5. The United States Government will PAY those doctors promptly (Within 45 days) for the care they provide veterans.

    6. ELIMINATE the “Federal Protection” Umbrella for incompetent QUACKS that the VA sends to other states to practice other than their own. Going to practice in Hawaii? You need to be LICENSED in Hawaii. Same applies to all other states.

    7. Any claim a veteran submits to the VBA that requires more than 90 days to adjudicate, is automatically found to be in favor of the veteran. If a VBA claim filed by a veteran is found to be a false one designed to scam the system, the VA will have to prove in civil court that a false claim was intentionally submitted.

    8. All veterans will be allowed to seek/retain the services of a Veterans Rights Attorney from their first initial contact with the VA.

    9. No AFGE, nor any other Labor Union business will be allowed to take place in any Federal Workplace. Conducting Union Business during working hours will be STRICTLY PROHIBITED, and will be STRICTLY ENFORCED. Should any government employee be found violating this provision, it will result in IMMEDIATE LIFETIME DISMISSAL FROM ANY/ALL GOVERNMENTAL EMPLOYMENT.

    10. Attorneys for appeal will be retained at the former employee’s PERSONAL expense. U. S. Taxpayer’s will not be subject to payment of legal bills for incompetent or dishonest personnel with regards to Governmental Employment.
    You have my contact information Mr. Secretary. Call me anytime. I have a lot of ideas to help you improve the services provided to my fellow veterans. I will not hesitate to speak up at all.

    For my fellow veterans who have been ill-served by this CLUSTERFUCK of a train wreck called the VA over the years:

    Our battles overseas were far less stressful than our war here at home. Never Cruel or cowardly. Never Give Up. Never Give In. We are on the Righteous path.

    POTUS Reagan broke up PATCO in the ’80’s. Time for POTUS Trump to break up the AFGE. Most of our current Congress Critters do NOT have Veterans Interests at heart. Perhaps their replacements will. VOTE OUT all these WORTHLESS INCUMBENTS.

    Give their replacement’s one term to take care of Veterans who put aside their own personal lives to answer this nation’s call when she needed them. Many of those Veterans suffer the remainder of their lives for doing what most of their countrymen had not the courage to do.

    If they cannot MUSTER THE STONES to do it properly – – – vote their worthless asses out as well. Party should NOT MATTER. What SHOULD MATTER is their VOTING RECORDS ON VETERANS ISSUES.

    Rhetoric is cheap. Congressional Voting Records speak louder than words.

    NO Combat Veteran should be surprised when the next McVeigh or Congressional Baseball Team Incident occurs. Bound to happen. Just a matter of time . . .

    We have now reached the next accelerative phase of our country falling apart. Country before Party. Principles before Personalities. Always.

    Want to REALLY fix the VA? The next SecVA needs to be a former Enlisted Man with a few serious axes to grind against the VA and the AFGE. Apparently, Former Flag Officers and SES appointed Civilians can’t cut the mustard . . .

      This is disturbing, this case [Stratton VA] goes back to 2013 and before—kidnapping veterans for days —“restraints for 49 consecutive hours;” depriving Veterans of correct medicines [“5000 times in on year”].

      And everything appears to be fine—I was told during my Congressional Campaigns in 2002-2010; and even now.

      What were the Doctors getting away with?

      Murder?

      At the Phoenix VA we know 508 Veterans did not walk away, as of October 2016.

      And Mayor Stanton does not want the President to come to town. Why?

      Just imagine Trump in the VA asking random questions?

      Why was management being pricks to everyone and refusing to do their jobs?

      Denying Food, Medicine, toilet paper, clean water, basic services?

      Did management know their guilt?

      It is an ugly picture—and it is just a peek into the filthy window of the VA’s Management over the decades [Carter/Reagan/Bush/Clinton/Bush/Obama/] or just six presidencies.

      You do not see Trump smiling—because he knows—and that scares the shit out of everyone who is covering up.

      1. @Don Karg, always a welcome voice. I can’t imagine how many Veterans have lost limbs and their lives, because of the VA. We don’t have the AFGE, they do. If Veterans had an AFGE, we wouldn’t be treated like second rate citizens.

I believe that Designated Whistle Blowers, should have special authority, to document incidences, that are possibly against company policy, or the possibility of being in violation of State, or Federal Laws, which governs any situation, that is deemed with a high probability of the possibility of the loss of any types of assets or funds.

    Whistleblowers really need to be truly effective in what their goals are, and itis very important, to determine the current total, of any and all assets of the VA which will be inventoried.

    The Veterans Administration needs to be Audited. An Audit would reveal many great things for possible News Stories. – – – Nutter.

  7. That nurse should be working with Veterans, not locked up behind the scenes. They haven’t changed, still screwing with whistleblowers. @Ben, the new site, is new. I’m not good at New, maybe in a couple years.

    1. Good for the nurse in doing the right thing in reporting patient abuse. Hopefully this and other WB cases will change the corrupt behavior that occurs so the va can start regaining veterans’ trust again.

  8. This type of behavior occurs with all Government Jobs, you will either get fired are demoted for doing the right thing. I’ve always been a person if something is unrighteous on the job, it bothers me to keep unrighteousness to myself. I applaud Valerie Riviello-Drew, we need more people to come forth the same as she has done.

  9. I’m so glad you spoke up. This happen to me were my hands got blu blue. I am a whistleblower and osha in san Francisco denied my case after assault and alot of other things they did to me at the hospital I worked at. There is alot of corruption in these hospitals as is the OSHA in San Francisco. I wish they would clean the mess up. Mine happen in 2010

OSHA DON’T DO SQUAT AS THEY ARE LACKEYE’S FOR KAISER, federal contractor which is run by the DOD & kiaser is nothing more than a funnel of health insurance money for it’s industrial DOD contracts. CA. is the most corrupt state and don’t give a s–t about it’s citizens, whether they are veterans or civilians and kaiser gets the healthcare contract over most here in CA. Who can fight the military and those like kaiser? OSHA hasn’t had any teeth for decades and nary a doctor to run any of it.OSHA is just another arm of the tax payer sucking machine, whether here in CA or D.C. UNIONS, DUH! THE AFLCIO wrote up the contract for the fraud and corruption for public and private employers as with the SSA & Medicare too to get rid of high top paying older workers through workers compensation but there WILL BE MONEY TO PROP UP THE ILLEGALS(while American veterans & civilians live and die on the street). With 10 billion plus in an Ill bank, of absconding union members dues, A UNION can do anything with not one legislator holding any union/insure/ federal employer/DOD responsible and the magnitude of the corruption on theft of Trillions of tax payer dollars is palpable and again no one has the ability to fight it except for whistle blowers who are treated like criminals. Hallelujah for this woman and the management who harmed her even more as well as the vets, should lose their jobs, benefits & go to jail for maliciously endangering our vets and violating her rights.

  10. Another example of a shockingly incomplete investigation.

    There is no way a VA employee at her level is asked to step down such that she has to fight to get her job back. She was essentially demoted. Where is the documentation showing the reason she was demoted? She wasn’t some new nurses aide or cafeteria worker, she was the nurse manager. Which VA manager decided she should be fired for reporting this? Which VA manager encouraged some IT flunky to go into her computer and remove documents? Yes, it’s a federal system, so yes it can be monitored, but there is nothing in any federal monitoring that suggests your documents will come up missing. What were those documents? Reports of patient abuse? Emails to her managers? Responses to their bullshit charges? Proof of other abuse?

    Since this clearly involved upper management within her hospital, where is any evidence of VA management above that hospital investigating this?

    Where is any evidence of upper management reporting this abuse to outside authorities?

    Where is any evidence of Shulkin and Congress stopping this crap that exposes taxpayers to thousands of dollars in settlements because of corrupt management in the VA?

  14. Hi all. I’ve been researching comment plugins for the past month and decided to experiment with this one for a couple days. It has features I liked and seems better than the previous Jetpack plugin I used. Many commenters in the past wanted to use the thumbs up / thumbs down tool, so I found something that worked for that purpose. It also places the comment box at the top instead of the bottom of the page.

      1. I like the more tidy look of new format but will be honest in that have never been a fan of a thumbs-up/down type comment system as it can be a tool for potential bullying, so something to keep-in mind.

      2. Can u imagine what that veteran, veterans felt when the staff dog pilled them. The fear !.
        What happened to the veterans, how did the VA compensate the veterans. Really can you imagine about 4 or 5 people grabbing you.

        Not only were they restrained I’ll bet they were given a shot of something to make them comply.

        This is not funny at all. I’m glad the employee blew the whistle and got her job back.

        But those employees that retaliated against her should be fired and all their benefits taken away and they should be shamed in public.

        How many of these veterans have killed themselves or turned to hard drugs and now will not seek the treatment they need and deserve.

        Why, does it aways be about VA employees, how about the veterans that are harmed, who is defending them.

        When carp like this happens, veterans should be compensated and a letter of apologize.

        If a veteran even complains about their care, they are punished by the disruptive committee or filled with drug’s to make them submit.

        This is just crazy ! How would any of you feel being ganged up on and seeing someone with a needle coming at you.

        This is criminal. The VA employees always state they are afraid of veterans, when the veterans should be afraid of the employees !

        This should be a really big RED flag, how dangerous the VA really is. Veterans deserve much, much better.

        But no the VA always claim the veterans are plain crazy and have the public believing their lies.

You still need to get a forums section up and running as well as possibly a more immediate real time group chat system.   15. The real truth is that this woman should have been promoted and put in charge of all of those folks…instead of being alienated and pushed out of the system. The idea that the VA would not reward and encourage this type of behavior only shows how deep the corruption in the unionized system is.

    Dump the unions. Get people like Valerie invested in management and fix the system. The reason they alienated her was because she bucked the back door that the union controls. The union is corrupt, and thinking that those folks will do anything to fix the system is like giving the inmates full charge to run the prison.

  16. The last time I saw a total eclipse here in Oregon it was 1979. Today another sunset and sunrise in the sky will happen in a few hours which will end my wait of nearly 40 years to see one once again.

    So in that lifetime I have lived, let us peek back in time and see just what Congress was up to regarding bills passed in 1979 regarding VA. Gosh…I wonder if we might find ANY clues at all tied to the Sun going out i the sky that might help explain such an utter contempt for law by VA Directors at these medical facilities. Surely, the two events are related….

    Here is a cut and paste from a bill that passed in 1979-1980. Read this carefully and ask yourself what the primitive peoples must have thought when they too saw the Sun turn black; they must have wondered, “WTF???” Just why in THE HELL would Congress pass this quoted excerpt in 1979? Did the dark Sun drive them mad?

    “Exempts physicians, dentists, nurses, and other health-care professionals employed by the Department from the Senior Executive Service. Converts VA non-physician hospital directors into the VA medical personnel system and exempts them from the Senior Executive Service. Stipulates that such directors shall remain eligible for bonus awards provided by the Service.”

    So is this like a blanket purchase agreement? They are exempted from the rules of the SES but still get bonuses??? WTF?

    But more to the point, just how many thousands of OTHER paragraphs exist in law like is one? I guess not a lot has changed from four decades ago at all. The Sun still goes black, and the VA is the same as it always has been and always will be.

Sterilizing and Proper Anti-Microbial Transfer Practices (second title was just made up) – – – I’m dumbfounded, on how supposedly Professional Surgical Medical Centers can be so damn lax – a – day – sick – all behavior pertaining to safety of transplanted bodily tissues, organ, or to properly sanitize medical equipment.   18. Last night, while deleting some utube videos, I ran across one that was so horrendous, I forgot to write down the title and who it was from:
    It concerned “organ transplants, at VA Hospitals, being held in ‘dirty water’!”
    The reporter was going to have a “live broadcast”, at 5pm edt, with a “VA WhistleBlower” over this egregious act against veterans!
    If anyone can find the video, it would be great!

  19. Thank you, Valerie Riviello-Drew, for your brave stance against the most corrupt federal agency, the VA, and looking-out for ethical treatment of Veterans!

    This story just shows how the VA is utterly threatened by competent and ethical employees doing the right thing. The corrupt beast called VA has absolutely no interest nor plans on reforming. At all.

    We need an entire agency full of cloned Valerie Riviello-Drew’s to have a better VA and ethical treatment of nonhuman test subjects.

    Thanks Benjamin! What can we do to encourage the minions at the VA to turn Whistleblower? Pretty sure it will have to have greener gra$$ on top it’s septic tank because the AFGE septic tank’s offerings in the swamp are plenty.
