RICO: How One Law Created To Violate Mafia Could Reform VA For Whistleblowers

One author thinks it is time to reimagine how VA whistleblowers should approach retaliation and reprisal using RICO to get real justice.

Following retaliation, the primary focus of whistleblowers tends to be on seeking monetary compensation or reinstatement through the Merit Systems Protection Board. Instead, lawmakers and whistleblowers may be better served seeking criminal actions through RICO to expose VA for the organized crime ring many of its senior employees have created.

While I am familiar with how RICO works, and am interested in researching Civil RICO – the part where you get treble damages – should any researchers have insight, I thought it is a good time to mention it here. Now, that is not the purpose of the cited article which focuses on how RICO may impact whistleblowers, but I like the Civil RICO option.

After all, our whistleblower hero discussed yesterday, Valerie Riviello-Drew would have benefited through evaluation of RICO and the criminal endeavor that affected her career.

Excerpt Explaining Whistleblower RICO Option

According to the CDN article:

Whistleblower RICO would only apply to federally recognized whistleblowers; if it passed and was effective other similar laws could be passed to protect municipal, corporate and other whistleblowers.

To be a federally recognized federal whistleblower one needs to take allegations of fraud, waste, and abuse to a recognized federal agency. This includes Office of Inspector General, Office of Special Counsel, their Congressman, their Senator, Occupational Safety and Health Administration (OSHA), etc.

Since all of these agencies have appropriate forms to fill out for whistleblowers proving this is easy.

Second, that which the whistleblower blew the whistle on would need to be proven. Proof should be broadly defined and thus the right prosecutor and the right jury would need to come to an understanding and this would minimize the risk of corrupting the law.

Third, any individual who is charged under whistleblower RICO would need to commit at least two predicate acts of whistleblower retaliation. The predicate acts would include all the predicate acts of RICO but also things like wrongful termination, isolation, wrongfully passing over for promotion, and other acts of common whistleblower retaliation.

Once again, these acts must be proven to be specifically retaliatory for whistleblowing. This will also be broadly defined so that prosecutors would need to make their case to the juries and each jury would need to decide if it was proven beyond a reasonable doubt that the predicate act was done to retaliate against the whistleblower.

    1. ANutterVet, I don’t know if the Captcha has cut down on comments. Those that commented here before are still commenting…perhaps not as frequently.

      I find some of the Captcha stuff difficult to do on a phone since the images are so small. When making the first comment today, I had to do Captcha twice. Every comment after that I have had to do Captcha again. Not as easy as before, but if it helps Ben cut down on admin time spent removing spam, I guess it’s a plus.

  4. So for over 3 months I changed my diet, eating less sugar, and consuming more insoluble and soluble fiber for poo bulk, and to feed the good gut microbes. I’ve had great success in this time, I’m more regular compared to taking the stool softeners and laxatives. I actually been having more bowel movements. And, my poo’s texture is more uniform.

    Many VA Practitioners, don’t recognize or has a good understanding on what rolls, that the microbial balance in one’s gut plays in ones health. Plus, there isn’t much discussion about leaky gut too. As a matter of fact, there’s not much discussion going on about best ways to keep one’s diastalsis following to increase transient time.

    I’ve been keeping track of the food, vitamins, amino acids, nootropics, or superfoods, that works in increasing the bowel movement frequencies. A big challenge, to increase the flow of the dump. May be I might be able to make some extra monies in helping those to knoo how to poo. – – – Nutter.

  5. It seems the more conservative red states treat veterans worse than blue states. I’m not a liberal but I noticed this. You look at the Phoenix VA and wonder why a red state that claims to be all for veterans would all that to happen to veterans at the VAMC in Phoenix. I hear most of the other red states have terrible VAMC. Pretty much all of the red states in the south east have VAMCs that are murder factories. I live in California and the VAMCs here aren’t great but they are a lot better than the red states from what I’ve read from vets who’ve experience both.

    1. Lily, I have gone to VAs in both red and blue states, and all are horrible. There are some that are less horrible than others, but they are the exception.

      If you researched the articles here on Ben’s web site, you would see specific examples of horrible care or corruption across the US, including and specifically California.

      1. I have a coworker who just got a surgery at the LA VAMC and he says it went well. They were using doctors from UCLA. He says it’s one of the best doctors in the country. I have read some bad stories about the LA VAMC on yelp, but haven’t been there myself.

  6. I’ve always said, and I continue to believe, that whether Trump fails for no reason of his own, there are many who feel that pre-Election Trump let these people down. And, I also have mentioned in the past, that Trump’s base is being hammered with headlines of incompetency. Be for-noticed, that there is a very strong movement running against Trump to stop bullying type tactics, and relics that remind us of the Civil War Period. Our Country has an area that contains, and then sets off a critical nerve pertaining to current social issues.   7. The VA and VA OIG, need help. It’s just wrong to have to report to whom you are investigating. What ever can get these AFGE, and SES’s held accountable is desperately needed. Management in the VA needs a total overhaul. Veterans need more input in their treatment. Veterans should be able to find out if their Dr. has passed his medical licence.

    1. As is typical with most legislation, it is incumbent on the individual to prove the merits of their WhistleBlower complaint. The vast majority are unfounded as the VAOIG works for who? And, taking it to the OSC is only possible if your complaint is founded. As someone in the system currently, the corruption, abuse and mismanagement is so widespread that the only possible fix is for the swath of GS13/14/15s to be removed. As we know, this will never happen. The VA Accountability Act, while well meaning, is a farce at VA. Removing senior leadership is not the solution, removing the buried bureaucrats is the sole solution.

      1. I would actually say getting rid of *both* are essential; senior leadership (because they are impotent and corrupt) *and* removing buried bureaucrats and *both* can be eliminated at the exact same moment because they have each other’s heads up each other’s asses.

    While I (and hopefully many) people appreciate you sharing this knowledge with us, I strongly believe that the problem here is application and/or enforcement.

    For example, the Whistleblower Protection Enhancement Act of 2012 (“WPEA”) provided that the MSPB could grant compensatory damages in whistleblower cases. Now, unless I need to follow the MSPB’s rulings on cases, I have not heard of one case where a whistleblower has been compensated.

    In my case, I reported the VA’s allowing unauthorized access to my VA/medical/private/claim records to HHS, the OSC, etc. And, despite the VA threatening me with HIPPA violations in response to my EEO complaints, nothing has been done to the VA – HHS and the EEOC are playing “hear/see no evil”. I plan to file suit in court (under the Federal Torts Claims Act/FTCA), but not holding my breath. I mean for years the VA has been violating veterans’ privacy rights and use these violations to retaliate against whistleblowers (by showing our private records to unauthorized people)…and, the VA would’t persist in this if they knew there were legal, administrative, and/or criminal repercussions.

    Years ago, I reported to the FBI and then Attorney, Sally Quillian Yates, the blatant perjury that took place in my MSPB hearings and my complaint was ignored and I filed suit in court. Well, guess what? The FBI and Yates claimed they had no administrative obligation to investigate/prosecute my complaint.

    So there you go. The courts and agencies (i.e. HHS, FBI, FLRA, MSPB, GAO) aren’t enforcing the laws we have on the books to deal with these criminals – so not holding my breath with RICO.

    Hopefully he’ll visit the VHA! Maybe, IF he does, he’ll talk with some of the veterans, who’ve been screwed over by the VA?

    What I’ve also read, was the Govenor has basically limited his visit (?)! How that’s possible is beyond comprehension!
    Let’s hope the “Antifa and BLM” groups don’t cause a disruption out there! As their claiming to do!

  10. Here is the real rub I have with this idea. In order for it to possibly work, a well intended whistleblower would need to ask their congressional representative to file on their behalf or in some way provide the forms and oversight. The Congress would be allocated funding for this.

    The VA is part of the Executive Branch. This is what our founders feared THE MOST because this is PRECISELY the type of thing they were fleeing from – corrupt government put of the reach of The People.

    They recognized that at heart we are all greedy assholes and that corruption is not born from the minds of a twisted few evil folks, any more than slavery was born from out the whim to persecute and torment. We all come out of Mom on our birthday and nobody I ever heard of spit out the mucous plug and said in clear voice, “Thanks Mom!”

    I personally came out screaming for something to eat godamnit! And something warm now! And get this godamn turd out of my ass, RIGHT NOW! It is in our born nature to grab everything we can and to hell with anyone or anything else. I came out wanting things furiously as did you. Then we grow up, right?….

    So the founders divided our government up into seperate pieces with each substantially out of reach of the other. This is so that any one branch that throws a tantrum simply cannot scream loud enough to upset the entire boat. Seperation of powers was put into place as a balance between the need to give government powers and the inborn human desire to grab it all.

    So when the whistleblower goes to his congressional rep, and that rep is given authorities normally granted to the Executive Branch because we no longer trust the agency within the Executive Branch then we once again are ignoring the seperation of powers enshrined in our Constitution. We would be giving the Congress a tool. I believe that Congress is already chock full of tools. However this tool would have the ability to cross the line into the Executive Branch….

    Can you not see how this tool could be used as leverage or a bargaining chip that had ZERO to do with the best interests of veterans? VA is completely outside the control of the Executive in charge today. Of all the people on planet Earth alive today, he alone cannot seem to keep even one of them fired. Ironic, right? Trying to add a tool to correct this when the Constitutuional tools in place do not work is frankly nuts.

    Every layer we continue to add to this onion just makes the onion grow bigger, not better. We either pull it out of the garden, or we live with rotten onions – there is no alternative.

Legislative (Congress), Judicial (Courts), Executive (President and cabinets, va included), if i go to my congressman that is legislative, if it goes to Congress/Judicial, then the Executive branch has to answer. The Rico laws are for organized crime and that unfortunately is what the va in my opinion has become. If the processes are controlled in a way to violate Veterans rights by the denying of medical care so they die. That is a crime. I see this as a possible opportunity to expose corruption. I see your frustration and believe me i understand. I have had no hope in any resolution when the va controls all the outcomes.

        The first edition of VA was created in 1921. Within months the corruption was already rampant. Criminal minds do not sit around and wonder what to do next. Criminal minds see everything as an opportunity. From the moment it was conceived the criminal minds among us, arguably concentrated in Washington DC, saw ENORMOUS opportunity for enrichment.

        Within 9 years they shut that agency down citing uncontrollable corruption and scandal.

        Then they created the current abomination. From THE VERY BEGINNING is new monstrosity has been caught over and over again defrauding American vets and the American public. We have tried as a people for generations to shut down VA corruption yet it thrives and grows and not even the President’s personal action of firing people for corruption works!         Can you not see the insanity of believing that solely on the basis that this idea seems brand new that it alone among thousands of other efforts will make one single dent in the corruption at VA? What on Earth has changed to now hold VA accountable for ANY law?

        They got it wrong in the first place then did the right thing and shut the monster down. It only took nine years the first time to shut this down, but by then the fix was in. Corruption gave birth to VA and this time from lessons learned they have never been touchable since and no ody on God’s green Earth can account for just where all the billions go.

        The ONLY way to cease the corruption is to do what they did nine years into the project. Shut it all down. Then we must resist the urge to create a “new” idea (again). We must cease believing that seperating veterans into their own unique social agency will EVER work because friend it never ever has. They simply reform in a more bulletproof manner. This current idea will not work based on the historical fact that generations of other Americans also had great ideas and energy to shut this down but the profit potential is enormous. There are too many billions involved and placed into the hands of too few people.

        Let me point out that RICO did not stop organized crime. They simply formed new strategies and organizations. There is ONLY a single way to diffuse crime – take the money out of it.

        VA must be shut down, or untold future generations of vets will continue to die and suffer and there ain’t nothing “new” about that.

    2. Two of us filed a fraud by a HMO in 2000. In 2001, we were told that we had no case but Grassley’s office offered his fraud detector staffer and it went to U.S. Manhatten court where the HMO’s massive fraudulent action were completed ignored and the auditor kpmg GOT fined 456 Million. All that was exposed was the tax deferrals that went to the Swiss banks with some military folks names on some of those accounts There was a whole lot more a lot more to this info we gave them.
      2 huge boxes of our years of research and the whistle blowing law firm took it all as their own along with our 10-15% award. But we’re going to do it another way this time, with lessons learned because the HMO IS none other than kaiser that is also the engineer of VA care and both civilians and vets have suffered and died because of kaiser being in charge of Americans healthcare along with specific unions like SEIU. but the aflcio IS NOT about the American workers, they’re all about the poor, women, minorities and older folks but THEY ARE the illegals and thanks to both parties, the American people have not only been trampled on and killed but their money has been stolen and used like what kpmg knows how to do, is help funnel it all to offshore accounts for nat’l & global corporations and countries that know nothing but profiteering at any cost, American live’s costs. The 2008 financial crisis did not have to occur if those involved in the original kpmg case that we gave to, had gone after all of the acts of criminality. The IRS too was involved and what have they been doing too is helping hide all of these years in the giant ripoff, harm & murder of American civilians & VETS, the GOAL.   12. I agree having whistleblowers covered under RICO would certainly help, but there would have to be a requirement that a second independent entity review and substantiate the proof.

    We have seen enough instances of VAIG investigations making excuses. If they alone have the power to determine if there is enough proof, then no case will be substantiated.

    The second requirement of any RICO law covering whistleblowers would be that an outside entity be mandated to review who all was involved in the RICO act, and recommend specific punishment, with zero discretion on punishment. Any settlements paid out from a successful RICO investigation would mandate termination and a referral to the DOJ for prosecution.

    On the other hand, veterans being able to sue under RICO would also help.

    Will any of this happen? Only if lawyers figure out they could get paid representing whistleblowers.

    1. Tell me Ex va, what VAMC in all of America is not engaged in criminal activity, criminal negligence, and criminal malfeasance? My God, since 1921, story after story after story of criminal conduct, skimming, kickbacks, fraudulent chatges, fraudulent statements, brutal retaliation against fellows and veterans, and corruption and malfeasance in EVERY possible form across decades of presidents promising to fix it has really only scratched the surface of the massive corruption involving billons of dollars at VA. What if it really IS true that only 10% of the corruption in any given corrupt agency is ever discovered? What if the one patient illegally restrained is really 10? Or 100? Or 1000? What if the 20 suicides per day is dwarfed by the 200 per day that die needlessly from VA? Can you imagine the slime we would find if the doors to those places was truly opened? The VA for eghty years has been the most corrupt agency America has ever known and it is only growing bigger and more corrupt as generations of vets pass through. There is no end in sight.

      Tell me exactly which one VAMC is not corrupt and then let us go to it and find happiness, the fountain of youth, and enough faiery dust for everyone to enjoy themselves and let us bask in the compassion, kindness, and caring glow of the VA folks at that place.

I feel if the vamc is run like organized crime, then it should be exposed and Veterans and the public should be given that knowledge. I have no idea what i will be experiencing trying this avenue. So far, no help and no justice i can see for Veterans lives being damaged by this corruption. I understand the skepticism and it is valid. This cannot go on forever it has to end sometime and i hope to see it in my lifetime.

  16. While it would be good if RICO would apply to VA Whistleblower’s, it would be even better if the VA/AFGE partnership were not the most corrupt agency in the United States.

    Better still if the VA actually took care of veterans properly. For that to happen, here is a very simple plan that when implemented properly should solve 90%+ problems that currently exist within the VA system – – – while reducing corruption, abuse, and waste:

    It is high time for some real leadership at the VA. Leadership that speaks truth publicly about how bad things have really gotten. Leadership that develops solutions to take better care of ALL our nations warriors.

    Leadership that recognizes that when they are doing a good job – – – it will be veterans singing their praises, rather than the VA needing a PR Agency to put out “Fluff Pieces” to mislead America.

    Current VA leadership has their Brain Housing Group the size of mice and their Hearts no bigger. It is about TEN YEARS PAST TIME TO FIX THE DAMN BROKEN VA:

    1. Recognize the problems inherent in the VA are SYSTEM-WIDE, not just limited to a few locations.

    2. Fire all the Lazy No Good Workers. Fire EVERY single AFGE/SES Employee.

    3. Sell off all the VA facilities. Alternatively, they may be converted into housing for homeless veterans.

    4. Issue all veterans a card that allows them to choose their own doctors within their community that they can TRUST.

    5. The United States Government will PAY those doctors promptly (Within 45 days) for the care they provide veterans.

    6. ELIMINATE the “Federal Protection” Umbrella for incompetent QUACKS that the VA sends to other states to practice other than their own. Going to practice in California? You need to be LICENSED in California. Same applies to all other states.

    7. Any claim a veteran submits to the VBA that requires more than 90 days to adjudicate, is automatically found to be in favor of the veteran.

    If a VBA claim filed by a veteran is found to be a false one designed to scam the system, the VA will have to prove in civil court that a false claim was intentionally submitted.

    8. All veterans will be allowed to seek/retain the services of a Veterans Rights Attorney from their first initial contact with the VA.

    9. No AFGE, nor any other Labor Union business will be allowed to take place in any Federal Workplace. Conducting Union Business during working hours will be STRICTLY PROHIBITED, and will be STRICTLY ENFORCED.

    Should any government employee be found violating this provision, it will result in IMMEDIATE LIFETIME DISMISSAL FROM ANY/ALL GOVERNMENTAL EMPLOYMENT.

    10. Attorneys for appeal will be retained at the former employee’s PERSONAL expense. U. S. Taxpayer’s will not be subject to payment of legal bills for incompetent or dishonest personnel with regards to Governmental Employment.

    You have my contact information Mr. Secretary. Call me anytime. I have a lot of ideas to help you improve the services provided to my fellow veterans. I will not hesitate to speak up at all.

        I lived out in the Black Hills, S.D. during some really intense forest fires and I lived in a canyon south of Rapid City, and what was really surreal, was not even 1/2 miles away was a small lake and park where the many helicopters were dipping their water buckets in for the fighting the fire. Sky even looked really surreal.

    From my very layperson understanding, I have evidence that I think may prove at least one instance where this law may work for me personally.
