Wall Street Journal: Peter O’Rourke Soon To Eject From Veterans Affairs

Peter O’Rourke, the former Trump-campaign staffer who became the acting VA secretary after ousting David Shulkin is set to leave the agency as soon as this week.

O’Rourke enjoyed a highly contentious relationship with the agency’s Inspector General and Congress while running the agency for a few months earlier this year. He was reported by House Democrats for perjury following a hearing where he delivered likely false statements about the Accountability Act and spurious decisionmaking on the law.

Last summer, O’Rourke helped stand up the agency’s Office of Accountability and Whistleblower Protection (OAWP). Whistleblowers believing the offices was actually there to protect them soon reported the office instead investigated whistleblowers and then turned the information over to the same management officials engaging in wrongdoing.

Once current secretary Robert Wilkie was confirmed, O’Rourke became a senior advisor. At the time, I predicted he would be ushered toward the door shortly after Wilkie’s confirmation. Well, three months later, O’Rourke is not moving toward the door.

Neither the agency or O’Rourke returned requests for comment.

Why Is OAWP A Farce?

Personally, I have been supremely disappointed with the Accountability Act and how the agency has addressed steeped concerns over corrupt agency employees.

Diana Rubens, the poster child for the Act following multiple hearings and pleading the 5th before Congress, was apparently allowed to retire this weekend. Other senior executes have been allowed to retire rather than being fired for wrongdoing.

Meanwhile, low-level employees including many disabled veterans have been targeted for removal for being disabled or blowing the whistle on wrongdoing. Rather than being protected by the OAWP, they are swiftly escorted to the door.

No one wants bad employees working at VA. However, corruption usually starts at the top and must be removed like a cancer. Instead, for the past 18 months, VA seems to be protecting many leaders we outsiders perceive as corrupt.

Why? Do we have it all wrong?

Another example might be the former acting Under Secretary for Benefits Thomas Murphy. I met Murphy a couple times. In person, he seemed like a good guy. But then he took horrible positions against Agent Orange veterans and presided over the creation of the disability compensation claims backlog… that later became the appeals backlog.

Political pressure that mounted as a consequence of the backlogs was used to pressure veterans to give up certain appeals rights in exchange for faster appeals under the RAMP program.

Once Paul Lawrence was named as the nominee to lead Veterans Benefits Administration (VBA) last spring, Murphy was quietly ushered out the door to run the Midwest Division of VBA – – and coincidentally in charge of the Regional Office responsible for my own claims (sigh).

Why does Murphy have a job right now? If he was as corrupt as his actions suggested, why is he still employed at the agency? Or, is something else afoot within VA that we do not understand as a member of the American public?

Someone out there knows the answers to these questions.

Can We Handle The Truth?

Last week, I spent a lot of time in Denver investigating fraud, waste, and abuse. At the end of the trip, I spent a couple hours defragging while watching A Few Good Men.

Like most veterans, the final scene with Jack Nicholson still strikes a chord and makes me wonder how similar VA is to the scenario described by Nicholson at the end before he gets arrested, “You can’t handle the truth!” He continues:

In case you have not seen the epic movie, basically, Nicholson plays a high powered Marine Corps Colonel named Nathan Jessup in charge of Guantanamo Bay pre-9/11 terrorists.

One soldier blew the whistle about a mishap and wanted to relocate to a different Marine base. Nicholson ordered a Code Red to teach the whistleblower a lesson. Unfortunately, the whistleblower died during the Code Red by mistake, and the low-level soldiers ordered to carry out the Code Red took the fall.

That is the beginning of the movie.

The rest of the movie involves the mountain of cover-ups the Marines carry out in an attempt to obfuscate the truth. In the end, Nicholson’s character spills the truth in front of a jury about how the Code Red was required to save lives and protect Americans to protect the code between Marines, which goes, “Unit, Corps, God, Country.”

When asked one last time if he ordered the Code Red, Nicholson as Col Jessup yells, “YOU’RE GODDAMN RIGHT I DID!”

Is this how senior leaders feel when attorneys like me press them about retaliating against whistleblowers? Are they protecting something by pushing back against whistleblowers?

I heard that is how Diana Rubens felt whenever defending her actions against Congress – – she openly complained about it during investigations into her improper receipt of a $288,000 moving bonus.

But how did she reconcile her actions in retaliation against whistleblowers with common understandings of right and wrong? Is there some other code VA leadership follows that is not understood or known to the public?

Rooting Out Corruption?

Congress passed a law that was supposed to root out corrupt VA employees. Many of the decisions by many senior leaders appear to be corrupt from our perspective. Yet, they retain their pay and retirement even after being outted for wrongdoing.

So, is there more to the story? Why are heads of senior leaders not rolling right now?

For the past month, I have written about this. And, during that same month, my Google traffic has tanked. During the 2016 election cycle, I slammed Hillary Clinton with religious fervor, so I assume the slump in traffic is in anticipation I may publish unfavorable information about one party over another this election cycle, assuming search engines bias results deemed political in nature from independent publishers.

Or, maybe Americans are too busy reading about Brett Kavanaugh throwing ice in a bar while drinking in that same bar. Shocker.

Enough about Google and SCOTUS. Back to unchecked corruption within VA.

Is VA Corruption Necessary?

Is corruption within VA not only systemic but vital for some other purpose other than helping veterans, like funding other projects necessary to national security that otherwise could not get funding?

Like the Nicholson movie, maybe there are certain truths within VA that the public does not want to know but is necessary for the government to function properly.

Ever since watching Shulkin explain why we need to spend billions on earthquake hardening for facilities in Wisconsin or other areas not at risk of earthquake makes me wonder where the money is really going.

Did Aurora VA really cost more than a billion more than estimates or did the funds go elsewhere? Normally, I would say follow the money. But in Denver, the money trail seems to just vanish into a bunker somewhere beneath the city.

As an aside, while writing this, I checked out Nicholson’s wiki page. Did you know he was raised by his grandparents and believed his mother, a showgirl, was actually his aunt? He didn’t learn the truth until after both his mother and grandmother died in his mid-thirties.

On learning the truth, he said it dramatic but not all too traumatic since he was well psychologically formed by that time in his life.

Be Honest With Us

Maybe veterans are the same. If the agency would just be honest with us about whatever it is actually doing, perhaps we could all move on rather than hold to antiquated ideas of its role in American society that really does not exist.

From my perspective, veterans are better off once they realize VA is not really a paternalistic organization there to serve us… even though that is what we are told. Instead, I follow the expectation the agency is an insurance company looking out for its stakeholder, the DOD.

DOD wants payouts to be low because lower payouts make the cost of war appear lower. The lower the cost of war, the easier it is to entice Americans into the next war. And the cycle continues, over and over. VA is part of this cycle.

Under that premise, life is easy since you expect the agency is always looking for ways to stick you in the back… like any other insurance company. Veterans, once they understand this premise, are no longer blindsided.

This is especially the case for Allstate, the company that promises to keep us in its “Good Hands” if we need to file a claim. The idea is the company will protect policyholders if issues come up. But, in reality, the company and many like it used block-and-tackle techniques to evade payouts to instead benefit stockholders.

Delay, Deny, Defend

Back in 2007 when the company was caught using the – – and I am not making this up – – Delay, Deny, Defend model to push back against clients seeking payouts for insurance claims. The company used algorithms to predict pushback from policyholders to save money and instead use the money to profit stockholders.

In a lawsuit, Allstate was forced to disclose McKinsey & Co slides revealing the Delay, Deny, Defend model it was following. (Not all too different from the delay, deny, hope that I die mantra VA is known for.) It should also not surprise anyone that McKinsey is also a consultant hired by VA for its business insurance expertise.

About the delay, deny, defend model, author Jay Feinman writes:

Insurance doesn’t work when the insurance company fails to honor the terms of the policy and its promise of security through the strategy that has become known as “delay, deny, defend.” The company delays payment of a claim, denies all or part of a valid claim, or aggressively defends litigation the policyholder is forced to bring to get what he is rightfully owed.

Sound like the backlog shuffle between wrongful denials at the Regional Office that then get passed up to the Board only to get remanded back to the Regional Office over the course of many, many years?

Most Americans are not surprised by this kind of model from an insurance company these days, but many American taxpayers would be shocked to know how VA uses that same method of claims adjudication against deserving veterans.

War Risk Insurance

But should we expect anything less from an organization, the Department of Veterans Affairs, that was formerly called the Bureau of War Risk Insurance?

While the name is different, much of its originating framework is still the same, using restrictive regulatory frameworks that pull money away from these programs for other purposes. It is amazing how much we forget about our own government after a few decades pass.

The diversion of funds worked under FDR in the New Deal in the 1930’s. There, veterans funds were repurposed using insurance policies to help fund other projects not related to veterans, at all. VA’s current regulatory policies are built upon that foundation. Should it shock us if similar, perhaps darker, diversions of funds were still in place right now? Will the $209 billion just approved by President Donald Trump for VA this year actually be used to support veterans?

To Wilkie, if you are reading this, we can handle the truth. We know you guys are not looking out for the little guy with your OAWP farce. Just tell us the truth.

There is a Code Red going on at every Regional Office across the country.

The TRUTH –>For whatever reason, VA likes and promotes leaders who can sidestep problems using any and all means necessary without getting caught by whistleblowers or IG.<–

When the Code Red is ordered, all the subordinates fall in line. Period. And good luck getting through the mountain of obfuscating claims and evidence all subordinates toss out to distract decisionmakers reviewing fraud, waste, and abuse.

That is what VA does. That is what VA likes. The agency could change if it wanted to but even after 38 USC § 714 was passed, there are no signs corrupt senior leaders will be held accountable.

VA will never change.

It is time we veterans get real and develop strategies that work against an agency designed to obfuscate the truth.

  2. The analogy depicted in this article is probably the best that I have seen yet pertaining to the widespread corruption at the VA. When government loses sight of its purpose at the expense of the taxpayers and our Veterans, then it’s time to restructure. Not only does it offer savings and solutions, it places us back on track to where our true allegiance should take precedence. Hopefully, the scope of investigation on this will reveal solutions that are impossible to defy. I already know that the money being spent will be better utilized where Veterans healthcare is concerned in the near future.

  3. How do people who never served in the military get approved for benefits and you got people struggling here for benefits with their delay, deny, and wait til they die?

    1. A really good question you ask, MDD. There have been a few for sure. Grand Jury in Honolulu about five to seven years back handed down some indictments for just that reason. I was living there at the time.

      VBA Pacific Islands had some egg on their face, but I never heard the final outcome.

      I am reasonably sure that there is more than one person collecting VA disability compensation who has never served.

  6. Thanks for this article, Ben. It is just in time for my telephone conference on October 15, 2018 ordered by the CAVC with the VA GC Office. My TDIU claim is 31 years old. My Seizure claim is 33 years old. My 38 CFR 3.154 claim is 28 years old. The incidence with the Navy is 49 years old. I have 3 cases open at the 10th Circuit. 1 Appeal of a District Court Claim and 2 petitions for review of “Agency” (Navy and VA) Decisions.

    Mostly rooted in VA failures under VA Directive 6300.

    Please do an article on the “missing medical records” that in the words of the BVA Judge, when I told her I was still trying to gather evidence that had gone missing from the claims file, said lots of luck. The BVA isn’t even able to obtain the old hard copy OPTR and IPTR.

    I’ll ask for a transcript of my hearing and provide it if you are interested. Or you could come in as my rep and take your own recording.

    VA will never change? Sure, they will. Change is the only constant in life. The question is which way will the VA change? As bad as things are for deserving veterans now, they could be worse. Probably will in short order if the VA (as we currently know it) continues to “care for him who has borne the battle . . . “ in the manner they are.

    Those words from their motto (based on my experience with them since approximately 1995) are the most dishonest and cruel joke that has ever been played upon me in my lifetime.

    I have had countless hours to think about how things could change for the betterment of ALL veterans at the VA. And I have come up with many ideas that could (given a reasonable amount of time) make a serious dent in the corrupt culture of the VA.

    Unfortunately – – – it will require educating the American Public writ large. And agreement of veterans on some very basic principles leaving all the politics out of it. The end goal being to inform the American Public just what is really going on with the VA, and why America must take care of her veterans.

    I have set up an e-mail “jimclement91@gmail” should any of the regulars on the board wish to engage in some serious discussion with respect to some of those ideas.

    Some of those ideas may seem aggressive, but we all know the deeper the cancer is embedded in the host when discovered – – – the more aggressive must the treatment be to give the patient the best chance of survival.

    Until then, I leave you with this:

    It is way past time for some real leadership at the VA. Leadership that speaks truth publicly about how bad things have really gotten. Leadership that develops solutions to take better care of ALL our nations warriors.

    Leadership that recognizes that when they are doing a good job – – – it will be veterans singing their praises, rather than the VA needing a PR Agency to put out “Fluff Pieces” to mislead America and her citizens about what a stellar job they are doing.

    They are not. In fact, they are doing a very piss-poor job.

    The VA has a first-world budget which they use to provide veterans less than third-world medical care and benefits. Current VA leadership has their Brain Housing Group the size of mice and their Heart no bigger.

    It is about FIFTEEN YEARS PAST TIME TO FIX THE DAMN BROKEN VA:

    1. IMMEDIATELY recognize the problems inherent in the VA are SYSTEM-WIDE, not just limited to a few locations.

    2. Fire all the Lazy No Good Workers. Fire EVERY single AFGE/SES Employee.

    3. Sell off all the VA facilities. Alternatively, they may be converted into military barracks-style housing for homeless veterans. These will be run with military-style rules to promote good order and discipline.

    4. Issue all veterans a card that allows them to choose their own doctors within their community that they can TRUST.

    5. The United States Government will PAY those doctors promptly (Within 45 days) for the care they provide veterans.

    6. ELIMINATE the “Federal Protection” Umbrella for incompetent QUACKS that the VA sends to other states to practice other than their own. Going to practice in XX state? You need to be LICENSED in XX state.

    7. Any claim a veteran submits to the VBA that requires more than 90 days to adjudicate, is automatically found to be in favor of the veteran. Should a veteran file a false claim to scam the system, the VA will have to prove in civil court that the claim was falsely submitted.

    For filing a false claim, the veteran will be subject to ALL of the following:

    (A). The claim shall be denied. If the veteran has received any form of benefits because of the false claim they will be required to fully repay the benefits at cost.
    (B). The veteran will be banned from all VA facilities for the remainder of their life.
    (C). The veteran will lose any benefits they originally have or had, and will not be allowed to file for further benefits.

    8. All veterans will be allowed to seek/retain the services of a Veterans Rights Attorney from their first initial contact with the VA. This will help to protect the legal rights of veterans against corrupt and incompetent VA employees.

    9. No AFGE, nor any other Labor Union business will be allowed to take place in any Federal Workplace. Conducting Union Business during working hours will be STRICTLY PROHIBITED and will be STRICTLY ENFORCED. Should any government employee be found violating this provision, it will result in IMMEDIATE LIFETIME DISMISSAL FROM ANY/ALL STATE AND FEDERAL GOVERNMENTAL EMPLOYMENT. In this case the word LIFETIME shall be construed as meaning “Ten years after you are deceased”.

    10. Attorneys for appeal will be retained at the former employee’s PERSONAL expense. U. S. Taxpayer’s will not be subject to payment of legal bills for incompetent or dishonest personnel with regards to Governmental Employment.

    You have my contact information Mr. President. Call me anytime. I have a lot of ideas/solutions to help this nation improve the services provided to my fellow veterans.

    The ones promised, but never delivered upon. Veterans have been waiting for over fifty years for the fulfillment of those promises. I will not hesitate to speak up at all.

    For my fellow veterans who have been ill-served by this DERAILED CLUSTERFUCK of an AWFUL TRAIN WRECK CALLED THE VA over the years:

    Our battles overseas were far less agonizing than our war here at home. Never Cruel or Cowardly. Never Give Up. Never Give In. We are on the Righteous path.

    POTUS Reagan broke up PATCO in the ’80’s. Time for POTUS Trump to break up the AFGE. Most of our current Congress Critters do NOT have Veterans Interests, or that of the United States at heart. Perhaps their replacements will. VOTE OUT all these WORTHLESS BITCHES and BASTARDS.

    Give their replacement’s one term to take care of Veterans who put aside their own personal lives to answer this nation’s call when she needed them. Many of those Veterans suffer the remainder of their lives for doing what most of their countrymen had not the courage to do.

    If they cannot MUSTER THE STONES to do it properly – – – vote their worthless asses out as well. Party should NOT MATTER. What SHOULD MATTER is their VOTING RECORDS ON VETERANS ISSUES.

    Rhetoric is cheap. Congressional Voting Records on veterans’ issues speak louder than words.

    NO Combat Veteran should be surprised when the next McVeigh, Congressional Baseball Team, or Las Vegas Sniper Incident occurs. Bound to happen. Just a matter of time . . .

    We have now reached the next accelerative phase of our country falling apart. Country before Party. Principles before Personalities. Always.

    Want to REALLY fix the VA? The next SecVA needs to be a former Enlisted Man brought in from the general veteran population with a few serious axes to grind against the VA and the AFGE, with zero previous governmental civilian service.

    Apparently, Former Flag Officers and SES appointed Civilians can’t cut the mustard . . .

      We all know every damn thing can be weaponized. Politics today has saturated every little segment of living. Those who deny that are dumber than post turtles. Next comes religions to the so-called professional classes, and secret clubs of the bi-peds and feeling some are special, should control the world, censor, ban unwanted information, revise history to their benefits, have ruin institutions of learning, put fear in most pawns and destroy others.       Ben posted about the OAWP. I thought for a second good it’s needed. Blinked and thought, nope, this too will be corrupted like everything else. See “politics,” “corruption,” “religions,” secret societies in high secret places, protect the old corrupt regime and guards. All those above the laws and immune from any form of prosecution. Then BINGO. Here comes reality shortly after.

      Like dealing with the VA isn’t enough or been part of all the retaliation all along for exposing some corrupted things locally. Since it seems a mole hill of an issue can turn into stacked Mount Everests or Mauna Keas.

      Ben mentions “A Few Good Men.” I’ve asked many kinds of varmints out there why they do when dealing with abuse, corruption, no due process, go mobster, what they do to those in the public sector, etc. “Because we can.” Those who benefit from corruption, dirty politics, nepotism, etc. ‘We vote the corrupt in to keep what we have and for the continuity of it all for our families.’ To…’so we can see deplorables (or men) like you ruined.’ “You don’t fit into the contemporary progressive community.” “You are either for us or against us.” How many times have we heard that one from all parties and groups?

      Dealt with this for years now. Since dealing with the VA, more corrupt politics into the computer age if whistle-blowers are not killed off and die from some strange accident, killed off by other union members or the likes of the Clintoon family, thugs and hit-people to include Marx-females, they can expect all kinds of fun. If they are true whistle blowers that have made serious enemies full circle.

      Lost employment to being locally black-balled by various sorts.

      Person and property threats, damages, etc. Free from LEO interests.

      Your ‘federal mail’ delivery may be jacked with or something ordered with claims of delivery and punched into their systems… never arrive. Then told we may have stolen the items for some odd reason. No need to try the Feds with such complaints.

      Local business will refuse to do businesses with you.

      No use attending any town meetings, period. But you many be expected to stand and say the pledge with a full court of Democrats, some on the councils being X Marines, X Army, X Navy, or above them all… the never grow up college elected that was in the Peace Corps! Fact. Can’t forget all the college Alumni connections from here to DC either. Oh and all the religions represented, attorneys, Chambers folks, activist, etc. All those who in turn stab citizens or people like me in the back and are the same who censor the hell out of us with media present also. All the same cliques and creeps.

      Don’t expect to do what every other citizen, pawn, townie, un-targeted vet can do. Chain of property deeds won’t be found. Maps that some town attorney claims changes our lifestyles and services to safe the town tax dollars. No copies of them will be given. However, they took my street sign down. Made my road an easement (bout four hundred feet) and told to take care of it myself. Pavement to white rock. An old gimp has to haul trash 300 feet down the road for pick-up… if they do. No more front of the house pick-up. Like the local civy hospital refusing to give me copies of my med files. But that too is kosher, legal, and state supported by all. To black-balling me from health care, plumbers, realtors, tree trimmers, and many more refusing to do work for me or even call and let me know in emergencies they will be a no-show. Or am told we got some calls about you, or so and so has mentioned you downtown, or asked if I am the same person that lived there back during some event or a past discussion with the mighty lefty Chambers of Commerce and their female herd of control freaks and cultural Marxist. Man haters.

      Remember my post about Duke Energy and after two crews were out here a house fire nearly occurred? Then they denied the crews even being out here. Oh and their main supervisor also sit on the Democrat filled town councils and throws money out to the local activist and so-called out reach liars and community clowns. I can go back years to the present and all it has done is increase in severity and wide spread. Especially since the college cliques and Dems have total control like the Masons, Catholics, others, have total control. Can I trust the cops, courts, VSOs, state officials of any kind, the media, to emergency responders? Hell …. ha ha… no. Nothing to do about the harassment to death threats. Cop sez gotta wait for some damage to be done and know who and where it came from. ROTFLMAO

      VA will never change like our sick corrupted culture short of an act of God or millions upon millions like the vagina hat wearers to come out in force to block and lock DC in until some major changes occur there and simultaneously state by state. I won’t hold my breath and will do a “Windguy.” I’ll put something on the barbie and blend up some popcorn and remove the hulls so as not to gag on.

    2. I have been in the system over 29 years and the VA has wasted taxpayers money and still doing it denying Vietnam Veteran’s widow her benefits because they have red flagged her file. It is ashame a widow is done this away and no one will allow her letters to reach the Secretary of VA.

  8. At the time, I also predicted the VA Accountability Act would in-fact be utilized as a tool AGAINST whistle-blowers and was only allowed to become an “Act’ in order to TRACK ALL whistleblowers.

    Ben, grand article and comparisons. Several issues and tangents can be taken from it if one cared to or have had the unfortunate life experience to do so over insurance topics and shareholders income over all else.

    Can we handle the truth? Some of us not all. IMNSHO not many at all. We have seen first hand on this board alone how some want us totally silenced… or dead for speaking out. In college towns they all seem to want us just…. dead and destroyed. Just for “progressiveness,” “sustainability,” United Nation’s agendas to communitarianism. Many things are taboo to be mentioned let alone deeply discussed, researched, exposed. Things haven’t changed in that aspect, or over “whistle-blowing,” truth telling, exposing evil and corruption in my life time. I paid the price many years ago, and still, for speaking up, asking questions, to speaking some truths, and standing up to a variety of things/people/cliques.

    Allstate, barf. Far left wingers that support idiots like “Code Pink” and other activist groups militant/violent or not or pretending to be American. It’s bad enough the machine and systems will not exempt veterans disability pay or back pay from bankruptcies forcing many into a Chap 13 preventing a Chap 7 for extra pay. No-one wants to address that issue alone. Then comes the insurance part of it. Allstate and others go out and inform clients their property insurance is cancelled due to a bankruptcy, put on a watch list, making it difficult to find other insurance coverage just over the bankruptcy. Then the state/city inspectors come out for inspections like a roof among other things. If the roof is fairly new but has those dark stains from trees they demand a four year roof be removed, replaced with brand spanking new visually appealing ones along with other demands forcing some to go without insurance or forcing some to go back into debt, if allowed, to bring the property up to Martha Stewart and college campus styled appearance. One vicious cycle for profits and to appease and raise property taxation for property upgrades and improvements.

    Not that many will ask why all this. The above not bad enough. The insured, bankrupt, is put on a black list akin to those being on the “Domestic terrorist watch list” because ‘stockholders’ and LEOs, state’s fire department heads claim those who file bankruptcies and looney veterans with disabilities are more apt to commit crimes like insurance fraud like burning the home down, so they can move, buy dope, or making other false insurance claims…according to those in power positions and to protect stockholders. Now try to get them to repeat that crap so it can be recorded, or on paper. Not going to happen.
