VA Employee Accesses Private Veteran Data After Termination, Caught Selling It
Little Rock: One former VA employee was caught by law enforcement trying to sell private personal data of veterans on the black market.
Phillip Hill, of Benton, Arkansas, formerly worked as a database manager for the agency in Arkansas. He was caught trying to sell personal data in his possession after termination such as data of veterans, their family members, and VA employees.
Hill attempted to sell the information for $10,000 to a law enforcement informant after he was fired from employment December 6, 2017. Despite the termination, Hill indicated he could still access veterans’ personal information remotely. It is believed he was able to do so using either a computer he kept or a server he may have stolen.

The ex-VA employee faces other counts of aggravated identity theft and possession of device-making equipment. Hill apparently used private information to create at least one fraudulent identification card and was in possession of blank identification cards.
Hill is presently out on bond with a trial date of March 5, 2018.
Fraudulent medical exams leads to FMCSA debarment

The Federal Motor Carrier Safety Administration has debarred a business man and a certified medical examiner from doing business with the federal government for five years.
According to the U.S. Department of Transportation’s Office of Inspector General, David L. Biersmith and chiropractor James Lindsey were involved in fraudulent medical examinations of commercial truck drivers and veterans. Lindsey, Biersmith and his business, Industrial Medical Center of Independence, Mo., were officially debarred on Jan. 17.
On April 20, 2017, Biersmith pleaded guilty at U.S. District Court in Kansas City, Mo., to making false statements and to healthcare fraud. Biersmith was the owner and president of IMC, which provided medical services to drivers of commercial motor vehicles, including drug tests and physical examinations required by FMCSA regulations.
“Although Biersmith did not have a medical license or other medical credentials, he signed the name of a legitimate chiropractor, without permission, on medical examination reports and medical examiner’s certificates for at least 65 commercial truck drivers,” the OIG news release said.
Biersmith was sentenced on Aug. 18, 2017, to five years of probation and ordered to pay restitution of nearly $40,000.
On Nov. 29, 2016, Lindsey pleaded guilty to theft of personal property.
“Under Biersmith’s direction, Lindsey performed disability examinations for the Department of Veteran Affairs that he was not authorized to perform,” the OIG said. “Specifically, between August 2013 and December 2013, Lindsey participated in 53 examinations of veterans seeking disability ratings and submitted to the VA approximately 209 Disability Benefits Questionnaires that falsely stated another doctor had performed these services. Biersmith was aware Lindsey was not qualified to conduct the exams. This fraudulent act cost the VA over $39,000.”

Investigation launched at Maryland Veteran’s Cemetery

CHELTENHAM, MD. (WUSA9) – An investigation at the Cheltenham Maryland Veteran’s Cemetery has been ordered after a family complained they were hustled through services for their mother, refused permission to witness her burial and are now unsure where she was ultimately laid to rest.
“I need to know that she is where they say,” said 72-year old Marine Corps veteran Skip Giddens as he struggled with his emotions Monday. His wife Lynta was buried at Cheltenham January 2.
Maryland’s Secretary of Veteran’s Affairs George W. Owings, III visited the cemetery Monday after receiving the complaints and has “ordered a complete investigation into the situation,” Owings wrote in an email to WUSA9.
In a complaint sent to Maryland legislators and veteran’s organizations, Lynta Giddens son Chris Teegarden called what happened on the day of his mother’s burial “vile ineptitude”.
Teegarden said the family was told their pastor would have only 7 minutes to perform a committal ceremony in the cemetery chapel and they were denied their request to witness the burial afterward, in violation of the Department of Veteran’s Affairs written cemetery policies which allow 20 minutes for ceremonies and attendance at burials from nearby walkways or roadsides.
“My father and I pleaded to be allowed to watch my mother, his wife, be taken to her final resting spot, to which we were emphatically told “no”. After the committal service, and against the direction previously given, I took it upon myself to walk over to area H3 to try to observe her internment. I arrived too late,” Teegarden wrote in his complaint.
Teegarden said he questioned workers who left him unsure about where his mother had been buried, especially since Teegarden said the temporary marker for her was 15 plots away from where he was being directed.
“I stood there as I watched three grounds keepers pick up three temporary markers and shuffle them to alternate spots. The grounds keepers could not tell me exactly what gravesite they placed my mother in and even tried to have me go back to the office and have the paperwork changed to reflect a different site location,” Teegarden wrote.
Teegarden and his father said the moving of markers after questioning workers was like witnessing a shell game.

Between September 2013 and May 2014, Maryland resident Russel Ware stole more than $21,000 in VA disability money by wiring payments in the names of legitimate beneficiaries to his personal bank account, according to the statement.
The 39-year-old from Upper Marlboro also directed additional disability benefits totaling nearly $46,000 of VA hardship money to a friend, Jacqueline Crawford, in Gulfport, Mississippi, between October 2014 and February 2015, the Justice Department stated, and Ware admitted he instructed Crawford to transfer more than $13,000 to him as a kickback.
According to the statement, Ware and Crawford were not entitled to receive the money.
In February, Crawford pleaded guilty to a single count of theft of government property and is awaiting sentencing.”

Maybe if the VA spent less time investigating any and every whim, phobia, or personal grudge held by ANY VA employee over ANYTHING then perhaps they might be better equipped to find folks among themselves breaking the law. How can VA police detect crime within their own ranks when they focus energy outwards towards the veterans themselves???
VA is using its police to track down criticisms of VA policy posted online that they deem non-threatening just to see if the critisizer will then threaten to kill somebody after the VA police call them! Look at all the bloody time they spend trying to hunt down vets while creeps like this who should have been an obvious man to watch and monitor closely and are working at VA. It sickens me.
Perhaps I am seeing this wrong or misinterpreting VA in this matter but I think not. I am now absolutely certain that VA law enforcement actively pursues a policy of attempting to elicit threats from vets by calling them in their home about trivial non threatening matters just to see if the vet will then threaten. This is alarming to say the least. Full recorded conversation I just had with VA police was forwarded to the author of this blog via email. VA pooice called me at home today to discuss a non threatening (their words) post on facebook then told me that pften when they call vets about this they will then hear a threat they can act on.
This sickens me.

Your situation is why I have stayed away from FB as a now-deceased good Vet buddy of mine had the VA’s own psych hack use social media against him before the DBC and his banishment from VA healthcare…guess what a VA Psych Hack told him? (I recall writing Benjamin about this some years back)
They told him that by using FB and the like, he was showing he really did not have PTSD…and they fucked with Robert long enough he outburst, which caused ultimate banishment…
…unfort., Robert went to the streets for pain relief and died about 8 years ago, one of the early casualties of fentanyl -laced heroin. Yes, he made that choice, but the VA kind of made that choice his only available one at the time and the VA also…knew that, I’m convinced of it.
Robert was a RN in military so he knew exactly what to ask for on the streets after the VA cut him off abruptly and I still believe the VA outright killed him.
Sorry for rant. Your situation brings a lot of not entirely dealt with emotions and am *GLAD* you messaged Benjamin Krause. Your case should be the can of worms that turns the VA inside-out and instigates true reform.

When he said the bit about calling and getting vets to make threats “all the time” it chilled my bones. He assures me that I am not under investigation then says they called to determine if I intended any “foul play. Is it?” Fuck sakes, is WHAT foul play??? He tells me I am not being investigated??? Here is the next message the senior reporter sent me just now (35+ years as a reporter here). She has written three articles about me – one about triumph over adversity in life then a few years later two about the VA troubles. I sent this recording to her and she said;

thanks man but no need to call OIG. I forwarded the mesage now to two journalists and have given both permission to use as they see fit. The press is really the call here. I forwarded it unsolicited to our host as a matter of VA interest and to my reporter friend. If the press deems it newsworthy then the most worth it has is in the hands of the press.
As far as I know it is within the VA cops rights to find then to use VA records to cross reference a name from a non-threatening facebook post, to then obtain my phone number, then call me at home to see if I posted the non threat, and then wait to see if the call can elicite a statement of intent to harm when none was reported to begin with. OIG would be right to say they too as police enjoy free speech rights to call my unlisted phone number to check out a facebook post critical of VA to see what my frame of mind was.
The fellow from VA police seemed to be saying that they frequently get vets to utter something that then is actionable in their view by calling this way. If true it means Roseburg has been succesful using this tactic to extend their authorities well beyond the boundaries of thier federal campus to reach out and with the sole purpose of seeing if a vet will decide to incriminate themselves in any way that can be used against the vet. The guy said it happens “all the time” after they call to get a vet to do this.
My concern Dennis would be someone at Roseburg calling the local cops, then after you were “hit”, claiming they reported a threat. It wouldn’t matter if the threat existed. They could claim just about anything was perceived as a threat.
“…and gee, our VA records show there were several contacts with Dennis by our VA police force. No, I can point to specific threats because of privacy…”

I understand your concern but honestly Oregon allows me to record calls. The VA has long been aware I record calls because I told them I do and they often complain about it.
This policeman from VA patiently waited while I got set up. My hunch is that VA has more to be concerned about over this small issue than me.
I am not concerned about Reverend Dennis because Reverend Dennis has faced down The Reaper far too many times to be frightened this way. I get triggered as a PTSD patient and this is simply part of the diagnosis for my heart to race and such. I have learned to deal with it and even now my initial symptoms like repeatedly restacking the laundry before realizing I was even in the laundry room has faded. It just takes some time and the imbalance is reabsorbed.
Remember always if you have PTSD to follow your safety plan. My safety plan when triggered is to call a friend (the reporter) who always seems to put me at ease and give good advice, then medicate with marijuanna which diffuses the anxiety a bit but does so pretty fast, and lastly to get off my ass and go do something. Sitting and pondering is doom lolz when initially triggered. Today I took a hot tub and meditated.
Today after I hit “Post Comment” I will employ the final step in my plan – I will disconnect from the internet and move to The Land of Dontgiveafuckrightnow. I’ll hang out there today and play with the dogs.

Never heard any ideas on what COULD be done to improve the Veterans Administration on this blog, Arnold? Hmmm. I (and many others) have been posting PRECISELY that type of information/suggestions for well over a year now.
Here is a “quick refresher course” that summarizes some of those ideas you claim are not being posted. I have been posting this at least twice monthly for the last seven months:
“It is high time for some real leadership at the VA. Leadership that speaks truth publicly about how bad things have really gotten. Leadership that develops solutions to take better care of ALL our nations warriors.
Leadership that recognizes that when they are doing a good job – – – it will be veterans singing their praises, rather than the VA needing a PR Agency to put out “Fluff Pieces” to mislead America and her citizen’s about what a stellar jobthey are doing.
They are not. In fact, they are doing a very sub-standard job. The VA has a first-world budget which they use to provide veterans less than third-world medical care.
Current VA leadership has their Brain Housing Group the size of mice and their Hearts no bigger. It is about FIFTEEN YEARS PAST TIME TO FIX THE GODDAMN BROKEN VA:
1. Recognize the problems inherent in the VA are SYSTEM-WIDE, not just limited to a few locations.
2. Fire all the Lazy No Good Workers. Fire EVERY single AFGE/SES Employee.
3. Sell off all the VA facilities. Alternatively, they may be converted into military-style barracks housing for homeless veterans.
4. Issue all veterans a card that allows them to choose their own doctors within their community that they can TRUST.
5. The United States Government will PAY those doctors promptly (Within 45 days) for the care they provide veterans.
6. ELIMINATE the “Federal Protection” Umbrella for incompetent QUACKS that the VA sends to other states to practice other than their own. Going to practice in Hawaii? You need to be LICENSED in Hawaii. Same applies to all other states.
7. Any claim a veteran submits to the VBA that requires more than 90 days to adjudicate, is automatically found to be in favor of the veteran. If a VBA claim filed by a veteran is found to be a false one designed to scam the system, the VA will have to prove in civil court that a false claim was intentionally submitted.
8. All veterans will be allowed to seek/retain the services of a Veterans Rights Attorney from their first initial contact with the VA.
9. No AFGE, nor any other Labor Union business will be allowed to take place in any Federal Workplace. Conducting Union Business during working hours will be STRICTLY PROHIBITED, and will be STRICTLY ENFORCED. Should any government employee be found violating this provision, it will result in IMMEDIATE LIFETIME DISMISSAL FROM ANY/ALL GOVERNMENTAL EMPLOYMENT.
10. Attorneys for appeal will be retained at the former employee’s PERSONAL expense. U. S. Taxpayer’s will not be subject to payment of legal bills for incompetent or dishonest personnel with regards to Governmental Employment.
You have my contact information Mr. President. Call me anytime. I have a lot of ideas to help this nation improve the services provided to my fellow veterans. The ones that were promised, but have yet to be delivered upon. Veterans have been waiting for over fifty years for the fulfillment of those promises. I will not hesitate to speak up at all.

I rest my case.
If he was able to continue to access VA systems remotely, then he either retained his PIV card after he was fired, or had a separate login account through VPN which the VA failed to disable after he was fired. Either is a possibility since the VA seems to be rather sloppy and grab-ass regarding computer security.
The question I have is this. Why is the VA not considering all of the data within that database to be compromised? If he was able to access it remotely even after he was fired, why is that any different than having the database on an unsecure laptop that was lost?
Is the VA downplaying this issue because of the cost if they were forced to provide veterans with ID theft protection? Since he demonstrated his willingness to sell ID information, is it possible he already sold some? I doubt the VA has done anything to notify any veteran that their data has been compromised. Why is this any different than hackers accessing OPM data remotely?
I wish I could say there would be a thorough investigation into all of this, specifically looking at computer logs showing how many times he accessed this data remotely, for what purpose and what was accessed, but this is the VA. I doubt anything will happen because it will expose just how bad VA is when handling veterans information.
The VA attitude is, “its only veterans data…what does it matter”.
Except we all know how many years it would take a veteran to get the VA to correct records if it is shown stolen data resulted in false records.

It goes straight to the DOD and National Security on how do we save guard our soldiers after leaving the battlefield.
Apparently, this is “new” to Washington D.C.—even though they have known about this since WWI.
Selling of Military information to an agent is Treason.

Any access to veterans data should have been locked out within an hour.
If you follow the timeline, he was terminated December 6th. That suggests something was going on before then. He was arrested 11 days later outside the VA data center. It was only then that the search warrant found whatever VA computer he still had at his house.
If this were thoroughly investigated, the VA would claim policies did not exist, were not followed, and more training is needed.
Also an additional handy excuse for Shulkin to ask for say, oh, another $2.1 Billion for IT “security” patches from the bandaid fixes that fell-off 3 months ago…again, ALL for the Veterans.
I bet the scenario would be vastly different and severe had he hacked into all AFGE Dues Paying Membership Lists and Upper Management AFGE Data…hell, the AFGE may have then sent him to Turkey where they could legally cut-off both hands for stealing and also cut-off both sets of toes just in-case the turd could learn to type/hack with his feet only…done!

DOJ is still full of shit, obscuring many cases that do not get published till months after the fact, in some cases.
They have a disclosure page that shows some disciplinary recommendations to OPR , which holds DOJ attorneys responsible for their shortcomings, but it is limited on what actions were taken.

Too bad it was really freakin’ cold last few weeks and I am betting that Vet that died in a VAMC parking garage in Wisconsin, I think, after being turned-loose by the VA in the coldest winter since ’77, would have LOVED a visit from a PR shot-seeking secretary…am not knocking VA Sec’s efforts, but those photo-ops SURE would’ve looked a tad more convincing had it been the torturous cold elements of homeless vets in the sub-zero elements last few weeks rather than sweater weather and maybe a tad further than the edge of the D.C. Swamp…
…what I am suggesting is, when the head God Syndrome is out kicking the pavement on a warmer winter day, something else is certainly brewing and this is a rainbow unicorn fart smokescreen. Could it be the data breach? Could it be any # of corruption situations going on at VA we do not know about yet?
Remember VA Sec. McDonald, while vacationing in Hawaii, he ALSO did some photo-ops on ending Veteran homelessness while Rome was still burning….? I also recall he did absolutely nothing to improve Veteran Homelessness and in-fact, it’s worse in Hawaii since then.
Was this Shulkin smoothing the still moist poo of the D.C. VAMC Director THUG situation….trying to convince D.C. Vets….come-on in to the VA….it’s all cleaned-up and SAFE again…come-on, trust me…again…come on, (pied-piper rat music playing the fade-out of photo-ops…)

“A video in which a Southern California high school teacher is heard slamming members of the military as “the frickin’ lowest of our low” in a classroom rant to students has gone viral.
El Rancho High history teacher Gregory Salcido — who also serves as an elected Pico Rivera city councilman and was once mayor — even goes so far as to refer to those who are in the military overseas as failed students who had no choice but to serve, “Fox & Friends” reported Sunday.
“Think about the people you know who are over there,” Salcido is heard saying. “Your freakin’ stupid Uncle Louie or whatever. They’re dumb s – – – s. They’re not high-level bankers. They’re not academic people. They’re not intellectual people.”

You would think the friggin lightbulb would go off in his head wondering why, if he can easily find homeless vets, why his staff can’t to help them.
Or why there are so many still homeless if his staff is doing such a bang-up job.
You can thank the Office of Special Counsel (OSC), Health and Human Services (HHS) and Department of Justice (DOJ) for keeping their heads burried up their butts on this matter.
I, last week, just gave an OSC attorney a piece of my mind for her and the OSC blowing off my allegations of the VA not properly safeguarding our private information and allowing this lack of security as a form of retaliation against whistleblowers and anyone who dare go up against the VA. They reduced my complaint to ‘speculation’, VA employees acting within their scope of duties…and the kicker? That by me, contacting the VA to check the status of my claim (which requires me to voluntarily identify myself by giving a VA rep my SSN), that I somehow consented to allow an unauthorized VA employee access to my records.
Gotta love it…gotta love it.
Well, at least we can rest assured DOJ is looking out for us with it’s dilligence in other matters – like that whole Russia collusion thing.
You are not required by law to give your SSN to those jackasses for id purposes.

Phillip Hill what a total dingle berry off the backside that is the VA. A total Meth-Head that is a total waste of oxygen. I looked into this junkie’s life and found he is a total loser from way back with numerous possession of Methamphetamine charges including with the purpose to Deliver.
From his criminal record it is clear that the VA did not fire him. He had to leave the job when an additional set of arrest warrants connected to Meth delivery charges were issued. Also, from his court records it is clear that he just didn’t want to pay up his Child Support that was owed.
What is truly amazing is this Meth-Head Dealer left his job at the VA and then went to work for the Department of Defense in November 2017. That was right after the new warrants for his arrest and bail Jumping came out the 20th of October.
In addition to the federal charges he is also looking at state charges for his Meth dealing behavior that now has a new charge of Bail Jumping tacked on when the warrant went out in October of 2017.
Some of his most recent charges in State court are from a traffic stop that occurred August 7th, 2017.
The Traffic Stop was for Driving with a suspended license. It turned into a Drug Arrest and its not the first time this fool was caught smoking Meth in his car.
Currently in state court he is Charged with:
1. Possession of Methamphetamine with purpose to Deliver 08-07-2017
2. Possession of Drug Paraphernalia 08-07-2017
3. Possession of Drug Paraphernalia 12-01-2016
This piece of VA also has restraining orders out against him and has threated to kidnap his own child after his shared custody was revoked because he refused to comply with court ordered drug testing during his divorce this last summer.
His Criminal Records for Meth go back to 2012 with all kinds of other charges. Apparently this punk likes to beat women from his court records. What a true waste of Oxygen.
How and why would the VA consider this piece of garbage Meth-Head employable?
Hiring a fricken junkie with numerous felony convictions for Meth as a Data Base Administrator.
He is not a Veteran!
They really need to fire the horse he rode in on at the VA. Anybody that was involved in hiring this Meth-Head needs to be made an example of and fired then prosecuted themselves.

Any idea when he was first hired Seymore? I thought he would have gone through a background check as a regular employee. Maybe not, but you would think that would be required if hiring for such a sensitive position. Seems the VA did their usual check of whether he might be related to someone and if he can fog a mirror.
Yet none of those questions will be answered if the VA can quietly make this go away with his latest conviction.
Now imagine what kind of VA employees will be hired using their new expedited hiring authority.

Sorry not sure of hiring date. Although it is certain according to records that the VA did know about his meth problem for at least a year.
That is while he had access to sensitive Veteran’s information as well as VA employee records. Including Social Security Numbers and employee private information contained in their employment records.
Anyone who worked with the guy and did not say something about the strange behavior should be drug tested also.
Also want to add that given he is a Meth addict he definitely didn’t have the job long. Meth addicts are very self destructive and do not last in any workplace environment.

I wonder why the VA allowed that. Who protected him? I can’t believe we would ever know though because I can’t believe the VA will investigate.
From his vanity license Plate number given during his prior arrest in August suggest he had a connection to the VA via DAV. His license Plate started off with the first three digits as DAV.
Also included in the following link about his arrest and charges concerning his current Meth Dealing charges. Note it appears that Hill was being given special treatment. Treatment that indicates he was working as a snitch.

To get a simple machinist job we have to take a drug test and have a background check, and clear DOD requirements, and international requirements.
As I heard several months ago the VA was going to clamp down on their hire requirements—–this must be the candidate that fit their profile for a newly hired employee. No wonder most Americans can not get a job that pays well!
