Swamp Gas: CALIBRE Attempts To Bully, Intimidate Veterans Rights Activist

A retraction demand letter from CALIBRE representation suggests the firm is contemplating legal action, possibly in the form of a defamation SLAPP lawsuit, against veterans rights activist Benjamin Krause. The row relates to comments Krause made in an article two weeks ago expressing concern over the promotion of the #2 at Veterans Benefits Administration and a contract investigation related to CALIBRE overseen by Margarita Devlin.

CALIBRE blew its swamp gas Krause’s way Friday afternoon before Memorial Day weekend, demanding a retraction and taking issue with use of the word “corruption” related to agency mismanagement of a contract with CALIBRE. The company’s counsel presented a distorted context of the statements that erroneously reflected that CALBIRE was the focus of the critique when the focus of the corruption addressed were public officials.

Generally, the term “corruption” references to acts of deceit or dishonesty carried out by public officials or those in power. (Oxford)

(The letter was received while Krause’s family prepared to mourn the death of Amie Muller, the 36-year-old mother of three including Krause’s first daughter, Caidyn. Amie died last year from complications of burn pit related pancreatic cancer.)

The false allegations described in the letter from CALIBRE below mischaracterize the article in question, The Swamp Giveth, And The Swamp Taketh Away: Margarita Devlin (Cocker) Promoted Into Number 2 Slot At Veterans Benefits Administration. (Those allegations were improperly sent to Krause’s law firm instead of his research company, Armo Press, LLC, owner of the DisabledVeterans.org website.)

The aptly named article addressed corruption within the Department of Veterans Affairs’ related to public officials’ administration of a contract with CALIBRE that was investigated by IG and the findings were published in a report.

Krause Responds

About the allegations from CALIBRE and article Krause wrote, he said, “What I wrote in the article was true and correct based on available information, which is generally a total defense to defamation claims.”

For any plaintiff to prevail in a defamation lawsuit, the statements in question must be false. If they are true, then there is no basis for a defamation lawsuit. Most defamation lawsuits are unsuccessful. In this context, should Krause refuse the retraction demand and CALIBRE litigate, the lawsuit could classify as a SLAPP suit since the statements in question are true and relate to agency corruption that is well known.

In this context, is it ethical for a government contractor threaten or intimidate veterans in this manner? How about a contractor for the Department of Veterans Affairs threatening a disabled veteran and prominent veterans rights activist? Did anyone inside the agency know or approve of the decision to attempt to intimidate Krause?

What Is A SLAPP Lawsuit?

“SLAPP” is short for Strategic Litigation Against Public Participation. Such lawsuits are “intended to censor, intimidate, and silence critics by burdening them with the cost of legal defense until they abandon their criticism or opposition.” (Wikipedia) “When a plaintiff brings a SLAPP lawsuit against someone attempting to exercise the right of free speech, it is usually under the guise of a defamation claim.” (Reporters Committee)

Krause plans to create a Legal Offense Fund to drain VA’s swamp of its corrupt public officials and to fight back against future false allegations, one FOIA at a time. “It is time veterans get aggressive against wrongdoers and agency malfeasance hitting back with FOIA.”

Addressing longstanding corruption in the agency, Krause said, “For too long, mismanagement and VA corruption has forced veterans to go without benefits Congress set up for them on behalf of the American voter.” He continued, “It is time we flush out corrupt leadership for the betterment of veterans everywhere.”

CALIBRE False Allegations Of Defamation

The false allegations are premised on a mischaracterization of the underlying article and make use of incorrect grammatical analysis to draw inferences that are otherwise incorrect or taken out of context.

Should CALIBRE take legal action, newer Virginia anti-SLAPP provisions could be implicated since the statements and commentary in the original article are true and protected by the First Amendment.

Accountability Act Farce?

The Accountability Act was previously believed to be the fix-all necessary to root out corrupt agency officials. One of the reasons many veterans voted for President Trump was his promise to reform the agency through accountability.

However, the office responsible for enforcement of the law has repeatedly been cited by agency whistleblowers as being a device to enhance corruption by removing whistleblowers rather than protecting them.

Clearly, veterans need to take matters into their own hands using all legal options available to them without relying on hollow campaign promises for reform.

A couple points worth noting are that the past and current heads of the Office of Accountability and Whistleblower Protection are past CALIBRE executives.

Peter O’Rourke initially headed the defunct office and was promoted to Chief of Staff. It is likely he signed off on Devlin’s promotion given his position. O’Rourke was replaced in the Accountability Office by Kirk Nicholas who is also a former CALIBRE executive.

Most recently, Vocational Rehabilitation & Employment had to answer why it failed to implement a $12 million client management system over a 4-year period without a deadline or budget in mind.

In the interest of egalitarianism (i.e., what is good for one is good for all) I’ll offer the same help that was offered to me when I contacted Mr. Krause for legal assistance in September 2016. “This is not the kind of case I would handle at this time. I would suggest finding a local attorney.”

      I screwed up yesterday at the meeting with the AG’s people. Too much pain, too many questions, too much to cover, too much heat and road tripping. I left not going back over the broken jaw issues. Wondering through the night how some can think only of the good, or easily skipping over little connecting dots like the AG consumer division not picking up the complaint, or connections, between local dentists not X-raying my jaw, not wanting to get involved with VA stuff or possible law suits. Then finding it hard to believe the retaliation, or just why things have happened as they have from the VA or the locals. No connections or covering-up? None of that “professional courtesy” I’ve been told about by others to my face? I’ll have to take some time today to get on my own “Popeye’s” self ass-kicking machine.

Also not to forget the issue of the oral surgeon and dentist not putting this info in file or how the jaw was broken or the two years of pulling out tooth and bone chips from my own jaw. Then the surgeon not wanting to get me a copy of my file for months, which is why I first contacted the AG, then a month later finally getting a so-called copy of the file which was not what I seen in the office and did not explain what was told to me by the surgeon and why he had to do what he did, and also what could not be done due to the amount of damage and splintering, etc.

    Whew! What a day.

    Anyone know if PC Matic is worth a hoot? Apparently in one of my updates along came malware using some kind of coming and going spyware, and goodies to create some issues. I can’t access what it all was but seemed to come by way of Microsuck that is supposed to be a layer of protection included with this machine. And being fully updated. Nothing else caught this but a Malware Bytes trial then quarantined it/them. Sixty three/four in total in less than a few minutes then opened up.

    Guess I have to sit down and write a book but the book or experiences it may contain need hard evidence to back some complaints up. Oral communication or what some VA staff may say over the phone, in person, has to be verified somehow. It is us vs them and their word trumps us again apparently. Same thing with the local health care stuff and etc. It’s all about proof, proof proof. So what good will it be to waste writing and trying to remember everything that has happened just in the past several years?

    The VA is a government agency so I have to play circus with another Senator with a VA attachment/staff. A release will be filed again and what I can verify in black and white and on the net too. If certain things or events are not logged into our files… too bad. Like they wanted a copy of the new contract we were to sign about being ‘forced’ to take SSRIs for pain to never using the Choice card again and to only use the VA even in emergencies, no civvy care at all. They found that one hard to swallow.

    Civilian health care, lawyers are needed. Since administration is unwilling to get involved or chastise their staff. Again, things must be recorded, witnessed, verifiable. They also can do, say, game all they desire. We have to prove certain things or everything. Time for a body cam for social use.

    Identity politics locally is yet another matter. Offices I called today found it hard to believe that local politicians, the party, and all their lefty groups and activist could be so malicious and mean. About the same attitude about PAs and staff at the VA. “Hard to think about they could do all that networking or passing along information on someone.” Duh, we are in the high tech age with instant contacts when wanted or allowed. And to think there is total belief that either party is about doing wrong or retaliation is hard to believe? With all the negative politics and corruption going on now for generations and today? Horse poop.

    All the phone harassing and threats are yet still another matter. Even though logs were kept along with some recordings that need to be heard in a court of da “law.” Even though the numbers can be at times traced back and shown on maps where they originated. Like from the VA and local hospital with some recorded. Nope, make it difficult as hell to protect ourselves and shine the light on Satan’s children and evil.

Should be an easy one to figure out why.   4. So upon further checking of Calibre’s website I couldn’t help but chuckle at the list of “products and services” they offer. Apparently the taxpayer is on the hook so these guys can draw up fancy little charts and tell funny little stories about how your business is supposed to grow and oh hey look at this little data metric over here it means what I say it means because you can’t tell either way! Oh and by the way? that’ll be 300 million USD please.

    The more I read about Calibre the more I realize this company is nothing but a leech attached to a host organism. This leech’s particular attack vector is to flood the host organism with a bunch of feel good toxins while simultaneously numbing the pocket where the wallet is kept. Since the wallet is where this leech’s particular form of nourishment is located, often called Benjamins, it draws as much as it can before falling off the weak and dessicated host to consume it’s food. This consumption is often in the form of extravagant housing, flashy watches, expensive trips and boats, luxury cars and trophy wives. The added side effect of this particular toxic creature is that the discarded host often has no memory of ever being preyed upon. When called before the Senate to explain just where all those benjamins went the answer is often “I have no recollection of those events, Senator.”

    If you should notice a Calibre sized leech attached to the neck of a host organism, usually a federal agency, you should get help in order to begin the removal process, it’s a complicated and tricky procedure and takes quite a bit of time. Unfortunately the only company out there that makes a leech removal kit is the Qui-Tam Co. and the instructions can be quite a challenging read. Normally one could go ahead and just burn a leech off with a hot knife blade but for some odd and obscure reason the FedGov has seen fit to prohibit such removal measures citing leeches rights to exist or some such shit. Actually I think the wording they used was “cost of doing business”

    Ben I’m down to help with the cause but if you don’t have a way for some real time communications to happen for coordination and strategy discussion then this probably isn’t going to go very far.

  5. Ok, So. I went out into my garage to smoke a bowl and I stood there looking around at the 4ish walls that surround that particular space. I thought to myself “Wylde…this looks to be about as big as an efficiency” And then the lightbulb went off. No, seriously the light bulb went off because I tripped the sensor. So I thought again. “Hey, maybe that’s what their talking about when they say contract effeciency.” So they must mean they have some, well maybe a lot for 20million, studio apartments that they want to put on lease to veterans and the VA was kind enough to cover the rent.   7. And again, on a side note. I’ve reread the article in question. While it implies a cozy relationship between Calibre and the VA. Nowhere does it explicitly state that Calibre is engaged in any type of illegal behavior.

    Exposing government corruption is always a good thing are we supposed to feel bad when the governments dance partner is also exposed as an accomplice? I believe that answer to be a resounding NOPE NOT ONE BIT.

    I am so sick and fucking tired of watching these “contractors” waltz on past us and use the VA as their own fucking personal slush fund all while giving us the finger and spitting in our faces. How can we reasonably expect the government to do a goddamned thing when contractors and corporations like Calibre and Goldman Sachs ARE the goddamned government? Can we even use the term contractor when discussing entities like Calibre? It seems to me that it’s more a finishing school for future government employees.

    Back in 2008 when the financial crisis was in full swing the watchword was “derivatives” and nobody could adequately explain just what the holy fuck a derivative was, not even highly educated financial people. There’s probably not a lot of people here who like Michael Moore but I found his movie on the subject pretty eye opening. Today I think the new watchwords are “contract efficiencies” does anybody know if there is a legal definition of that phrase? Because in my mind it’s highly subjective and purposefully vague.

    There’s a movie I watch all the time, actually it’s a 6 part mini put out by Sci-Fi channel around 2002 or so it’s called Dune and Children of Dune. It’s based on a series of books written by Frank Herbert in the 70’s it’s good sci-fi if your into it like I am. One of the scenes I’m reminded of regarding this whole bullshit attack on Ben is when the Emperor Mua’dib turns to his sister Alia as he’s boarding a “plane” to take his pregnant wife back to their desert town home. He leans in close to his sister and tells her “Time to settle accounts” meaning time to hold the plotters and the shitters and the schemers responsible for their actions.

  9. If what you posted isn’t true there would not have been the acid letter from CALIBRE’s lawyers. The VA in Washington DC is a swamp and it’s time that it was drained and restocked with people who care about the vets not the money it cost to take of them. The VA caled my husband and I up and told us that they had found a roster for his unit and his name wasn’t on it. How funny because nobody else who ever searched for his records found anything that might,could or did look like a roster. Do not stop exposing their corruption

He went on to make all kinds of statements and then when I challenged him on them he got pissy and had his attorney contact me and threaten a lawsuit. I replied to the attorney with proof of what I said and told the attorney that if he EVER dared contact me again about this or if he started to feel froggy, then start jumping. Either way I would make him wish that he had never been born as I would not only take his ass to court and win, but then I would take him before the state bar association and have them relive him of his law license for felony fraud against me. Never heard another word from him and the councilman was removed from office. Maybe Ben you should do the same thing? Show them you are not scared of them and make them back up their claims or back off.

    After reading a few of the cases he has represented the F might be for a grade or a nickname of Fruit loops.

    In one of the cases he lost and then again lost again on appeal. He claimed that it was the banks fault for a check that was altered from being a $250.00 check to a $250,000 check. He claimed the bank was in error because the bank left two much space on the line so the check could be altered. What a fricken Moron with no ethics and is freely willing to waste court time.

  17. It was only a matter of time before the swamp creatures began to show their colors again. They were only lying low, waiting to see just how far down into the swamp, POTUS would dredge.

    We are now 19 months post-election. By and large, the major swamp creatures remain and even with the well-publicized firings and resignations of key leaders; the massive army of self-serving, narcissistic lieutenants’ remain.

    Whether in the school yard, or in Washington, D.C.; being a bully doesn’t make you “right”. It doesn’t give you power. It only serves to show just how broken your moral compass is.

    Subjecting those who are the defenders of the truth; with such tactics is Bullying 101 and it is high-time that POTUS took a hard look at what is happening within the VA. It’s time this administration gets serious about draining the VA swamp as they promised all of us.

  18. Been waiting for something like this to happen. Having solid proof and recordings, plus going as public as I can, has kept the legal attack dogs off my back. So far. Wouldn’t matter with the local kangaroo courts or forced behind the door discussions, or called into the judge’s chambers, with no legal means to record the event. “No cell phones, electronic devices allowed beyond this point or courthouse or police station, no recording allowed.” Besides there are always all those other games they can play using LEOs and such. Those above the law, activist, agents, cliques, and those exempt from any prosecution can pretty much run rampant doing their thing.

    Going to try a out-of-town road trip today to try and meet up with a so-called ‘mobile operations attorney general out-reach meeting’ supposedly for public complaints or those with issues. Many phone calls and snail mail sure hasn’t been productive…. just the opposite with more excuses, denials and covering up. This is on my list for discussion with the clowns.

    Kudos to Rob O’Neill. At least the IT woman that turned down the info access was doing her job. Sure wouldn’t work locally especially when I have been told by VA IT not to question a highly VA trained and educated woman about what she, or her department, has done or about deleting information and my needed/useful communications on E-Vet messaging site. Wiped clean saved messages and all. Plus excusing other games being played on my E-vet pharmacy needs and such being changed on a daily basis making ordering or scripts a mess. And no official, staff or cop would dare come forward about any kind of corruption in my corner of Indiana. It would mean the end of their careers and lives in this state, period. If a person dares go against the state’s malicious and corrupt machines or networks you are finished for life. Black balled. Connections and wealth may help some if they do play ‘Whistle-blower.’ Or depending on how deep in the cesspool they dare to play in or report about.

    Also nice to see the day after Memorial Day the Legion and others who have lied and refused to help local vets with serious issues on TV bragging about our freedoms, no problems in ‘murika’ and how great they are… wearing their funny taco hats full of pins. Great show for propaganda purposes and showing just how damned two faced and corrupt they are with full support of lying corrupted media. Oh no we can’t get involved. “Our hands are tied due to politics.” “Would be a conflict of interest so we can’t assist.’ “Not part of what we do.” Blah blah blah.
