Tinnitus Anyone? 3M Covered Up Its Defective Military Earplugs Since 2000
In a settlement worth a paltry $9.1 million, 3M agreed to pay the government after being caught covering up its defective earplugs called dual-ended Combat Arms Earplugs, Version 2 (CAEv2).
The company sold its earplugs to the US military without disclosing problems with its effectiveness. Basically, the earplugs would come loose in the ear canal and not perform as well. Those curious about the lawsuit should look up United States ex rel. Moldex-Metric v. 3M Company, case number 3:16-cv-1533-MBS (DSC). (Note: I grabbed a photo of the earplug type from the 3M website, but the photo above may not be exactly the same earplug variant.)
“The Department of Justice is committed to protecting the men and women serving in the United States military from defective products and fraudulent conduct,” said Acting Assistant Attorney General Chad A. Readler of the Department’s Civil Division. “Government contractors who seek to profit at the expense of our military will face appropriate consequences.”
“Through rigorous enforcement of the False Claims Act, we protect taxpayer dollars from waste, fraud, and abuse,” said U. S. Attorney Sherri Lydon for the District of South Carolina. “And in this case in particular, we are proud to defend the integrity of our military programs and ensure that our men and women in uniform are adequately protected as they serve our country.”
“Today’s settlement will ensure that those who do business with the government know that their actions will not go unnoticed,” said Frank Robey, director of the U.S. Army Criminal Investigation Command’s Major Procurement Fraud Unit. “Properly made safety equipment, for use by our Soldiers, is vital to our military’s readiness. Our agents will respond robustly to protect the safety of our military.”
“This settlement demonstrates the commitment of the Defense Criminal Investigative Service and our law enforcement partners to hold companies accountable for supplying substandard products, in particular products that could directly impact our service members’ health and welfare. DCIS protects the integrity of Defense Department programs by rooting out fraud, waste, and abuse that negatively affect the wellbeing of our troops,” said Special Agent in Charge Robert E. Craig, Jr., DCIS Mid-Atlantic Field Office.
Hearing loss and tinnitus are some of the most common disabilities for veterans. Maybe 3M should pay the disability benefits rather than a paltry $9.1 million?
Ear plugs. I believe there was an article where the VA refused to accept defective hearing loss to those who shot shoulder held weapons.
The veteran’s who were denied might be able to use this report as new evidence.
Of course the VA will tell these veteran’s prove that you used these ear plugs. Nope wrong color. The writing on the package was smeared, denied. Excuse after excuse.

After Project War Path made a post which referred to NFL players who kneel during the national anthem as “overpaid turds,” Instagram blacklisted the company’s account for “hate speech.””

Well looks like 3M got off easy on this deal, by paying off the measly 9 million to the department of defense, instead of paying out millions to the affected veterans the 3M company swindled the veterans who paid dearly for losing their hearing, I believe there should be some recourse and allow the veterans to sue 3M in a class action lawsuit, only way for these veterans to get compensated
Got to love the stupidity of some of the small time non managerial type Doctors at the VA. Where do they find lawyers to represent them?
The doctor received notice that he was being fired because his clinical practice had “so significantly failed” to meet generally accepted standards it raised “reasonable concern for the safety of patients.”
In a hospital “Proficiency Report” on Manglik, the hospital’s chief of staff wrote: ”I have significant concerns about (Manglik’s) clinical competence. … Nearly 100 patients have requested another MD in the last year.”
So of course the incompetent Doctor Manglik sues the VA to try and prevent his firing. So, “in October 2017 reached a settlement with the hospital, agreeing to leave in exchange for $5,000 and a promise that his departure would be treated as a retirement and his personnel file would be purged of any reference to discipline or termination.
A lawyer for the VA later assured Manglik’s attorney that in the future, if prospective employers or other individuals were to contact the VA about Manglik, the hospital would say he retired and “that is all they would say and nothing more,” records show.
After the deal was signed, however, the hospital allegedly informed the Iowa Board of Medicine and the National Practitioner Data Bank that Manglik had resigned while under investigation.
In his lawsuit, Manglik alleges this was done “solely to meet the desperate national agency’s need to offset the relentless criticism of the agency for failing to report deficiencies.”
Manglik claims he was “a convenient and timely scapegoat to improve the agency’s statistics as quickly as possible after the election.”
In a sworn affidavit accompanying the lawsuit, Manglik said that by pursuing a deal that would allow him to retire, he was able to preserve his health insurance and collect retirement income that otherwise wouldn’t have been available.
“I have temporary employment which is now jeopardized, but my ability to transfer, or to see other opportunities, have been destroyed,” Manglik said.”

A totally incompetent Doctor can hire a shyster to represent him in a case build on years of incompetence while employed at the VA providing incompetent health care to Veterans and then whining and suing the VA for reporting his incompetence. If you guessed India you would be correct. The VA’s former Dr. Manglik medical school is reported as the King George`S Medical College University Of Lucknow.
As for the legitimacy of Dr. Manglik’s claimed medical education there are a series of problems which indicate he is truly a fake degree holder.
While Dr. Manglik reported to the the Iowa board of medicine that he graduated from the King George`S Medical College University Of Lucknow India in 1986. The schools Wikipedia’s page show that the school did not have a medical degree program until 2002. Also worth noting is that the school has been plagued by news coverage over the fake transcripts and degrees the university has issued. Especially in the 3 year attorney program. Given they do not offer a law degree.
So, basically a fake VA Doctor is now suing the VA because he not continue making money as a fake doctor. After all his years of service to the VA as a Fake doctor.
With the new ruling on Veterans now being able to file class action lawsuits. It really is to bad the Veterans in Iowa who suffered under the care of this Fake Doctor will not be able to find an attorney to represent them. It certainly would give the VA proper incentive to ensure they were hiring real doctors in the future.
But hey, maybe Veterans will get lucky and the fake Doctors lawsuit will make them consider not hiring fake doctors in the future.

The USG just let 3M off the hook. What 3M paid was contract damages and in so doing, the USG dropped any potential future claims from those who had their hearing damaged by these faulty ear pro. We, the end users will find that 3M is now shielded against future claims through this settlement.
So – Moldex is still around. 3M must have licensed the rights to manufacture and sell, or, they licensed the IP to Moldex. Either way, the feds went after the deeper pockets, and healthier litigation budget.
Love the platitudes from the prosecutors, and the Army Criminal Investigation team, “…. protecting our brave men and women, blahh, flag wave, blah, money rah rah…” Nine million – chump change. Eighteen years? That’s called cozy.

“The VA Office of Inspector General (OIG) substantiated allegations received in January and February 2016 alleging the Veterans Health Administration (VHA) was overpaying for prosthetic items because it incorrectly used Not Otherwise Classified (NOC) codes to classify the items for payment to vendors. Incorrectly using an NOC code can result in an overpayment because the payments are not based on pre-established reimbursement rates. For example, the Touch Bionics I-Limb, when classified with the correct code, costs VHA about $27,000. However, VHA paid vendors as much as $61,702 for the same item when classified using an NOC code. The OIG found that VHA overpaid vendors about $7.7 million from October 2014 through July 2017.
The OIG found prosthetists incorrectly used NOC codes to classify prosthetic items when existing codes adequately described the items. Prosthetists incorrectly used NOC codes because they were either unaware of the existing codes or because they allowed vendors to classify the items with NOC codes. The incorrect use of NOC codes to classify some prosthetic items was not detected because the Prosthetic and Sensory Aids Service lacked a process to monitor the use of NOC codes. Because prosthetists incorrectly used NOC codes to classify prosthetic items for reimbursement, VHA paid more for the items.”

Morris resignation could signal trouble with VA EHR plans

“The Department of Veterans Affairs has lost a key IT architect who had been working to ensure that the VA’s planned rollout of a $10 billion Cerner electronic health record system comes off without a hitch.
Genevieve Morris, a Trump administration political appointee who was on loan to the VA from the Office of the National Coordinator for Health IT, resigned abruptly from both agencies on Friday.
Morris served as principal deputy national coordinator, leading interoperability efforts at ONC, and in July assumed the role of chief health information officer for the VA’s Office of EHR Modernization—only to resign weeks later.
Morris announced her departure on Twitter, providing a copy of her resignation letter submitted Friday morning to Health and Human Services Secretary Alex Azar and VA Secretary Robert Wilkie.
“Over the last few weeks, it has become clear to me that VA’s leadership intends to take the EHR modernization effort in a different direction than we were headed, and since my service as CHIO was always intended to be an interim solution, I am offering my resignation to the administration effective immediately,” Morris wrote to Azar and Wilkie, without providing specifics.
Morris came to ONC in May 2017 as principal deputy national coordinator at ONC.”

We dug wells so they wouldn’t have to walk miles with tubs on their head or on sticks on their shoulders. They didn’t lift a finger to protect them when Charlie came visiting. We held sorties and told our south Vietnamese counterparts where to meet us and when. They showed up mid-Morning claiming they “are farmers first, soldiers second”. Most that I dealt with couldn’t wrap their heads around why we were there. Their idea of freedom as we know it, was to be able to raise their families under the same conditions they were raised in. An old adage comes to mind; One can not miss what they’ve never had.
The French got run out before we showed up and we didn’t learn a Damn thing from the beating they got. Our ROE had our hands tied. We would have lost less servicemen if we had worn blue helmets and left our weapons at home. I’m bitter yes, not toward the South Vietnamese but totoward the politicians that allowed us to be fed into the North’s propaganda machine. God bless John McCain. He took the punishment some of our politicians deserved. I was there 2 and 1/2 years. I also left in 68, October to be exact, but I don’t think we were winning. We were never meant to. On July 21, 2017, Casey Branscum drove his truck to a Walgreens drive-thru in Oklahoma City and handed the pharmacy employee a prescription for 120 tablets of Percocet.
The employee, noticing the prescription was the wrong color, called the doctor whose name was on it and found it was a forgery, according to an officer at the scene. Branscum, 29, was arrested in the Walgreens drive-thru lane and soon charged with attempting to obtain a controlled dangerous substance by fraud, a felony he would later plead guilty to.
At the time, Branscum worked as a nurse at an Oklahoma City nursing home and could reasonably expect his career would be harmed by the incident. But within two months of his arrest, Branscum had another job in Oklahoma City. It, too, involved nursing homes.
Word arrived in the email inbox of Oklahoma Department of Veterans Affairs employees on Sept. 18, 2017.
“Please join me in welcoming Casey Branscum to the ODVA team,” wrote Tina Williams, the agency’s compliance director. She said the 29-year-old had 14 years of long-term care experience.
Branscum, who two months earlier had broken the law by writing a fake painkiller prescription, was tasked with reviewing medical records to ensure compliance with rules and regulations. His starting salary was $43,662.
News of Branscum’s prior misdeeds “spread like wildfire” through the state’s seven veterans centers, one longtime employee recalled. Staff whispered to each other about the new guy, the one who was an accused felon. Rumors spread about his closeness to Williams, who lives on the same street in Yukon as Branscum. Disaffection with central office in Oklahoma City, already running high, only escalated.
“People were just flabbergasted that they’d hire someone like that,” said another employee, who spoke on condition of anonymity for fear of reprisal. “But you just knew not to ask about it.”
Employees sounded off to state auditors, who were preparing a report at the time on low morale and toxic leadership within Veterans Affairs. Branscum’s hiring showcased a double standard, veterans center employees felt, between their ethically upstanding facilities and a central office that had lost its way.
“It was unethical for him to be hired with the charges pending,” one employee said, according to auditors’ notes obtained by The Oklahoman in an open records request. “We would not hire an employee at one of the facilities under those circumstances.”
‘He has since been highly successful’
Shane Faulkner, a spokesman for Veterans Affairs, says Branscum does not dispense drugs or directly care for veterans. Branscum was forthcoming about his past when hired, proactively sought out treatment programs and voluntarily entered into a peer review program, which he continues to participate in, Faulkner said.
In January, Branscum pleaded guilty and was given a three-year deferred sentence as part of an agreement with prosecutors, according to court documents. He was ordered to attend Alcoholics Anonymous or Narcotics Anonymous meetings weekly for six months and pay $440 in court costs.
Two months later, Branscum was promoted at Veterans Affairs. He oversaw implementation of Point Click Care, a computer program for storage of medical records, which he had prior experience with during his time at private nursing homes.
“He has since been highly successful in this task,” Faulkner said.
Branscum, who did not respond to a request for comment, has received four raises since he started at Veterans Affairs less than a year ago — he now earns $63,662 — and has been an impressive employee, according to the agency’s spokesman.
Last month, it was Branscum who granted Veterans Affairs employees access to patients’ medical records on their cellphones. Depending who you ask, that was either a brilliant decision that allowed hundreds of veterans to receive critical medication or a major mistake that brought the agency under federal investigation.”

This is clearly ‘War Profiteering’, and since that time-frame of this drop in the bucket law$uit for 3M, we have been in constant WAR, I believe 3M should OWE VETERANS BILLIONS, that $9.1 Million really is chump-change that 3M tosses at dancing monkeys regularly just to pay to continue to pollute…in each State they have toxic plants in…I know, I grew-up in a very small farm town that 3M was able to pay a yearly recurring pollution fine, whereas my own family’s factory business since Industrial age of 1800’s was stomped out of business by these war profiteering toxic polluters, because my ,om and pop family factory could not afford to “Pay To Pollute and Play”…so this $9.1 Million is a low-hanging fruit that 3M is being given preferential treatment to continue supplying the machine, toxicities and dead soldiers in their wake…

To clearly state it correctly—-Management failed to protect the employee for 18 years and decided to go after the Manufacturer using their attorneys.
This item failure should have been detected immediately and Management/Procurement should have had the item corrected within Months.
