NBC Nightly News Picks Up Non-VA Emergency Room Bill Denial Story
NBC Nightly News with Lester Holt is now covering the wrongful non-VA emergency room denial story first exposed in 2017 leading to a nationwide investigation.
On Friday, NBC Nightly News picked up the story first broadcast by its affiliate at Kare 11 News here in Minneapolis. Investigative journalist AJ Lagoe investigated my personal story here in the Twin Cities after we realized VA was likely running massive denial scheme impacting veterans everywhere.
If you are reading this, you likely know a bit about me and the decade of research and time I’ve put in to expose various scandals at the Department of Veterans Affairs as a journalist who became an attorney using my VA benefits.
In 2017, I exhibited symptoms of a heart attack after a family member died and went to the nearest emergency room that happened to be a non-VA emergency room.
Fortunately, I did not have a heart attack, and we immediately notified VA of the emergency room visit to ensure it was covered since I have a 100 percent disability rating and was in the Minneapolis VAMC system.
Months later, I received a denial from VA asserting prudent layperson would not go to the emergency room with the symptoms I exhibited at the time.
Chest pains, shortness of breath, etc. And, “prudent layperson”? Who is a prudent layperson when it comes to symptoms of a heart attack? You do not pass go; you do not collect $200. You get your behind to the nearest emergency room because you may die. Odds are, when you have chest pains and shortness of breath, you may not be thinking clearly enough to Google WebMD and evaluate your symptoms.
All that common sense aside, VA says I was not a prudent layperson in that moment of fright and pain. So, now what?
I reached out to AJ to see if he was interested in covering it since, at least at the time, we were pretty sure if VA was doing it to me, a veterans rights attorney the agency is intimately familiar with, it was highly probable the agency was doing it to other veterans.
Our Hypothesis On Non-VA Emergency Room Denials
That was our hypothesis. I have a large following of readers. VA knows me very, very well. Former Secretary David Shulkin referred to me by name at the time. If the agency would refuse to pay my emergency room bill when exhibiting symptoms of a heart attack, they were probably doing it to loads of other veterans.
Our hypothesis proved true.
AJ investigated the story. After running my story on Kare 11, loads of veterans and whistleblowers came forward. Congress held a hearing. IG started an investigation. Many more stories were run by various NBC affiliates nationwide in addition to what Kare 11 was doing.
Just two weeks ago, IG issued a scathing report calling out VA for its shameful pattern of denial that has put veterans’ lives at risk. NBC Nightly News is now running the story. Americans are being encouraged to learn more about how veterans are truly being treated.
VA Puts Veterans At Risk
You see, most veterans know that when you seek emergency care from a non-VA facility, you are basically rolling the dice with your credit score because VA might try to stick you with the bill.
The prudent layperson excuse is merely one of many roadblocks VA uses to evade financial responsibility for emergency room payments.
The bureaucracy pressures low-level employees to not carefully consider claims but instead process claims at breakneck speeds resulting in wrongful denials. Veterans caught in the crosshairs get stuck with the bill.
Many veterans know they are at financial risk when seeking the quickest, safest route to care in an emergency, so they wait until VA opens or travel dangerously far to ensure they are not at financial risk.
In so doing, as a consequence of fear, some veterans have put themselves at risk of further injury or death. They travel hours to the nearest VA emergency room when their local emergency room is the better option.
Agency Robs Veterans Of $50 Million
The agency wrongfully denied over $50 million in just six months from April 1, to September 30, 2017. That is the period of time IG investigated.
Fortunately, reforms are underway and NBC Nightly News is covering the story. While the prospect of additional news coverage will likely not fix the problem fully, it will help tremendously.
Non-VA Urgent Care Denials
The new problem on the horizon will be non-VA urgent care approvals. I can guarantee it. Given the problems with emergency room prudent layperson determinations – – things the agency screwed up for decades – – how will they ever appropriately determine when a prudent layperson might think a problem requires urgent care versus emergency care?
Most of us are not doctors, and the prudent layperson standard is absurd when it comes to emergency care and now urgent care.
Who is a prudent layperson when it comes to medical determinations? Why not just a layperson?

Calling it “Systematic Pressures” is an insult to VA Secretary Wilkie and his Attorneys.
This is outright refusal to pay and deliver Health Care and the other required services to our veterans instructed By The People through Congress. It is also an act of Sabotage during several wars—I really hope these officials understand their own laws during WARTIME.

These officials are nothing more than Greedy Bastards who are taking the whole pie and saying, “Fuck Off what are you going to do?”
In the end the Greedy Bastards shoots themselves or go screaming and crying into the Patrol Car to be found later swinging from rolled up blanket in a prison cell [with the help of outsiders].

My dad never used the VA, a Vietnam vet, my mom was awarded “service related death” after I applied for her ( she didn’t think she would be entitled ). Funny thing is, they didn’t even fight it. Come to find out back in 1989 my dad requested ester to be tested for agent orange himself, I have the letter response with appt. scheduled. I can only assume he was told he didn’t have it. 2017 he died of it. Mom gets DIC but there’s no recourse for back pay. Never mind his quality of life, mental health, or possibility to have been treated for decades and lived longer & better. I want someone Leone to explain this to me.
I to have problems with the VA non VA emergency care from a civilian and rated80%IU P&T. My Piss poor care and delayed payments from the Orlando VA they didn’t even know what the procedure was on what to do when a vet calls saying they received non VA emergency care. I had to use the Madison VAMC to consult them on how to proceed my claim. I think this Veterans choice was a joke it should have informed all veterans the printed procedures on how to process a non VA emergency care for our service connected disabilities. The VA is constantly changing the rules on this and not notifying the Veterans on the changes. I received enough care just to stabilized myself and the Florida hospital let me go and I still had 3 days to go before I could get urgent medical care at the Madison VAMC otherwise I would have had to pay for anymore care considered non emergency care outside my medical district. Then the Madison VA discovered the Florida hospital doctors had a little scheme going on where they wouldn’t bill you for like 6 months and find they where charging you for pass due pills after 30 days. Like one person commented on the Florida hospital probably knew something of the VA procedures and tried taking advantage of them and the person who got mistreated was me. I still got a problem with a emergency room visit from 2014 that I had to pay for and because it so old that it was a $90.00 now is $3000. Because they didn’t credit the bill for the emergency room visit that occurred again in Florida where they didn’t have a VA hospital to go to and that prudent person said I should have waited 5 days to return back to Madison. They say I didn’t pay it. I have proof I sent half of the payment but the other half I cannot get proof of from my bank so I am stuck with this bill collector chasing me for a bill the prudent person from the VA said I should have waited for and I only hope is they take me to court and when I inform the judge that I am rated 80% IU and the VA is responsible by law for my medical care that I paid for and show him or her that I payed it but can only prove 1/2 I think the judge will dismiss it
Mike, I agree. The Congress and the Senate are pathetic. Potus should close VHA. I will not be voting period. No Democrat or Republican. Below 3rd World Country status. Sounds like an O-6 Medical Officer who was on USS Eisenhower 1985-9. Asshat sent two people home from Swells Point Clinic about a month apart. The first did as told, took some aspirin and died. The second went to the ER at Portsmouth Hospital and they saved his life from the MI he was experiencing as his wife helped him through the door.
We got stuck with him on IKE because of Medical Dept head got “relieved for cause”…
This is exactly like his no-referral edict on IKE that cost me the use of my Right arm.
Saturday I was given an anti inflammatory by the va that I am allergic to. The va doctor informed me that it would be okay to take this drug even though I am allergic to this drug because in had been thru chemo therapy 2 years prior and The chemo eliminated the anaphylactic shock possibility. Eventually I agreed to take the drug due to the chronic pain I was in.
15 minutes after taking the med I was in a coma. I managed to place a 911 call just prior to going unconscience. Emts saved my life.
The nearest v.a. emergency facility is a 300 mile drive.
Now the v.a. is not going to pay my ambulance or emergency room service.

Tell me about it!!! I hate the Memphis VA, rated by USA Today in 2016 at the bottom, you hear me? The very bottom. Maggots, sepsis, empty offices up and down, people sitting alone behind desks with nothing to do, a cafeteria the size of an Army chow hall with tons of fried chicken and unhealthy food, the salad bar only has to be filled once, instrument wrappers left in surgical sites, no name tags, dead bugs and spider webs in the return air vents, no one dressed like a medical professional, walking around in leggings that one would wear to the “club”, up and down the hall saying “Praise the Lord”, God is good–All the time,”packed waiting area with Vietnam Veterans sleeping while waiting a whole day or more, vagrants right outside asking for a cigarette or 50 cents for the bus. They don’t like me there because I talk loudly and give them a piece of my mind. I paid in advance for my VA care, and I have had no wellness check in the last 2 years.
The dentist (a teenager) told me that I “have just got to live with” my dental issues. I am not going back there, not even to save my Mama’s life. All the superiors who are in charge, I don’t know any names, nor have I ever seen any of them. They must be some kind of apparition. The employees park near the building and the patients catch a shuttle from the back 40. I have heard that they even send a bus down to Northern Mississippi to haul their asses to work. I am a veteran from a long time ago, and I have NEVER NEVER EVER seen anything like it. Not overseas where I was 2+years as a surgery nurse/tech, HARD SERVICE. Nor any of my state side stations. Currently I use my Medicare card to see a doctor, bought private insurance for dental care, and communicate with my mental health provider at another VA.
This is truly a crock of **** and it does stinketh. This is so hard to navigate, and I am going to move to where there is a REAL VA MEDICAL CENTER, like Leavenworth KS.
PS: I reminded one of the “Patient Advocates” that Mississippi is still a cotton growing state, and I can learn how to pick it before I die in such a place, from neglect and no appreciation for the blood that got on me in the OR!!!!!

NBC news, whomever, whatever, over anything does NOT matter. Just because it is some report on TV’s propaganda and white-washing machine doesn’t mean actions are taken like previous issues over the many years. Just more BS.
Odd too after finally finding it this report is at the end after all the other propaganda, BS, human interest and pity party stories are ingrained in the sheep’s heads before the quick chatter about vet concerns. And they are sure to use a female and some legal org that in real life refuses to go to some states or deal with some issues. Reasons are very obvious. And no mention of any cost and it sure ain’t free. Males seem below all others and can’t get the attention, care, representation, support, that seem to come rather swiftly and easily for some others.
Same crap came out about the Choice card while many of us here were told to never use it and at the end of my time at the VA told to NEVER use civilian care for anything including emergencies. Or in the beginning of the propaganda was told the VA needed notification 3 days before emergency use and to be cleared. So, so much for some news report meant to give the public and sheep fluffy feelings about how well we are taken care of. And all media ran from those reports and my claims of abuse to their threats. Where was NBC commie news on that crap? Same thing with all those VSOs and outreach groups that just shied away from some reality and truth.
Trying to play more of a social butterfly when up to it to get more community opinions. Online stuff is a waste of time like revolving communications with some agency or government official that leads no where but just more of our files floating around for more to see and laugh about. One blue collar pub I worked at many years ago and haven’t been in for near thirty was a treat. Only one drinking Coke. Several old timers still present and living the bar life and knowing little about vet affairs and our issues, and most being far left lefties to hilt.
So far the other vets there and around just simply didn’t give a damn and never used the VA. So far not many in others families ever used the VA. Heard a few typical horror stories but didn’t seem to be a bid to others or those giving the reports or stories. But claim we get quality care there and I must be a very bad patient. They know better. While some others I never knew were vets was spouting about how great it is to be around so many vets in the open and not facing what they did when coming home from Nam or service. And were not interested in any issues that would bring possible retaliation or the town’s mobsters down on their heads and family. But like most here admitted to how corrupt this town and state is and how dangerous it is to rock the local boat or step on certain toes.
So far they all, most, had other insurance programs from work, civil service unions, city workers and others with golden insurance programs so they don’t need or have not bothered with the VA sys and had no military connected issues or so they think or were told. Those special responders and others with great insurance also got the elite status of having benefits thrown for them over catastrophic health issues and a lot of community and clique support some of us can not attain or have. A few said so far the red tape, the long waits, testing, run-a-rounds, kept them from further inquiry with connected issues or getting local care, and messed up other avenues/times in their life.
Well, I want MY reparations and want to see some heads roll then we may see some change rather than all the expected up-lifting stuff. Or some will see some change… others hung out to dry and will still face hate and retaliation the rest of our lives. Still there are a lot of people and vets being treated differently but censoring and networking to share experience isn’t and wont happen. Not allowed. With others not very willing to discuss how they get by getting needed meds or avoiding revolving PCP care or mistreated. Or claiming up after saying they are related to this or that one and have those “associations.” Or free care if they have MDs or some other connections for some free care and very cheap surgeries or at no cost, or donated. Must be nice.

I have had denials on a VA consult thru a TRI-WEST approval! It is on my credit report.
They have even gone so far as sending the bill to TRI-CARE ????
Wild isn’t it the totality and major concerns in life boils down to our credit reports and scores? While they push many into financial crisis and the very sick game with it’s own retribution tactics and losses over medical bankruptcies. Then told our VA Dis payments or back is NOT exempt in bankruptcies and can lose it all since it depends on a Trustee judge and court. What a game it all is and most of us don’t win a lick.
Here’s another aspect on this issue:
The “billing departments” of the hospitals/emergency rooms are well aware of how VA REFUSES to pay for the care veterans receive! Also, It isn’t just the hospitals which have been stiffed by VA’s incompetent employees!
Therefore,
1.) Why would hospitals send bills in? (I know this to be true because it happened to me!)
2.) Why would the VA billing departments take the time, once notified, request any AND all bills from the hospitals, emergency rooms and or participating non VA healthcare providers/professionals?
3.) Why, when transport companies send in bills, they are DENIED by VA employees over claiming “duplication”! (This was reported to me by Susanne at “EVAC”! The company which transorted me to a non VA hospital emergency room. She didn’t understand how that occured. Because they only submitted the bill ($722.00) once!)
In my opinion, once y’all read the VAOIG Report, you’ll understand these incompetent VA employees did/do this to get favorable ratings! The higher the rating they receive – means
1.) RAISES
2.) PROMOTION
3.) BONUSES!

The bottom line is the Department of Veterans Affairs is a f””’g disgrace to this country. In my opinion if President Trump’s wants to be reelected, then the VHA section of the VA should be shutdown. Veterans care should be redirected via Tricare. Trump administration should do by executive order set up healthcare plans that offer medical care similar to automobile insurance policies. Auto insurance policies already deal with medical payments anyway. So just expand the private sector option. Honestly folks, before Obama stuck his nose in the healthcare industry in the private sector, the care was real quality medical care that was not as costly and expensive as it is today. I have the numbers to prove it. American govt is a disgrace. Too big to get anything done that would deliver Goodwill to the American citizens.
Now if only they would do something about the shipping from the VA. Seems I ticked someone off when I had the Director of the Hospital/VAMC and the Patient Rep and the Chief of staff go up to her office and show her SEVEN different faxes saying STANDING walker not standard walker because she REFUSED to give me the walker and tried 3 times to claim it was a standard walker and then wanted me to make three trips of 120 miles round trip (one when I didnt get the walker, one when they wanted to get my height and they refused to listen when I told them, and then the third to actually get the walker) total of 360 miles for a stupid walker. They even brought her a picture of it and threatened her employment if I didnt get the walker. So to get back at me she sent it Fed Ex. Signature required. I go and get my mother lunch every day as she has cancer and they knew this and I am in the process of taking medical tests before my knee replacement next tuesday. So its either I ignore my mother and the tests I need to have done before the surgery so I can be here for the package/Walker, or get my mom her lunches and take the tests and not be here when Fed Ex shows up and my walker is taken back to the shipper. This kind of retaliation on a Veteran also needs to stop! maybe NBC can look into this as well!

Active duty military members are being put on these psych meds as if the meds are candy. Benjamin, the military did not used to do this. And, if they did it was rare. Usually then, the active duty member would be put out without even limited duty for short while and without an appeal option. This is how it used to be. So Benjamin the government officials particularly the Democrats are the ones who are contributing to the suicides and to the dysfunction due to what they stand for which is death and govt dependence. Pay decent salaries, pay decent whatever and stop stripping the hell out of the American veterans and the Non-Veteran Americans. Put up or shut up. Get to the point. Many Americans are very angry. I am one and I know many more who are too. They need to put smartest heads together to develop more genius strategies to get us out of some of these other countries as per the wars. Guns are not the issue. The sources are the broken down nuclear family, obsessed pharmaceutical companies, unqualified physicians and medical professionals. Plus, oh yes, the school system. Let me fill you in and this is just like the VA. In the K-12 systems just like the VA they have rating systems with reviews with the 5 star and so forth. You will not like to hear this. The teachers spend most of their time having to document everything in the computer. Benjamin, this contributes to taking time away from the teachers that prevents them from doing their jobs of teaching the subjects. My point is when they document in the computer they cannot write about anything that they have not visually witnessed. I am serious. For example, if a kid gets into a fight and breaks the other kid’s arm and if the teacher did not see it they cannot report it or write it in their computer for the school adminstration like the principal of the school or even discipline the kids or even contact medical or even contact the parents.
Benjamin, only time the teacher can even acknowledge any situation is if she witnessed it. And, even then the teachers cannot do much. Left up to the principals who just kick down the road. Yes Benjamin. The schools are so worried about their ratings and political correctness that fail to do their jobs. This is what is happening in the VA. VA employees so worried about their bonuses and ratings that they too are kicking down the road. My point of all of this is our whole damn country has been turned to kicking down the road. Benjamin when issues are not dealt with and when these kids and adults cannot get therapy or some type of help, this is what is contributing to the mass shootings and suicides. Corruption. Mental health issues that are many times originating in the K-12 school system. But then too if the kid and adults get some help then from that point on, that person is diseased or persons are diseased. They get stepped on and discriminated against. Their opportunities in life get reduced. Benjamin, it all goes back to the labeling and identity politics which should not be. Benjamin see how all of this is connected. Democrat policies. This is why Trump was elected to change this crap to where it is not against anything that walks and breathes. Reality. Practical. Lawful. Humane. Genuine. This is Trump and Trump supporters.
