Headed To Washington DC For NOVA Conference

Well, it is about that time of year for the bi-annual NOVA conference to educate veterans benefits lawyers about the newest tricks and schemes at VA. In a couple of days, around 500 attorneys will be headed to the Hyatt Regency in downtown DC to hash over a variety of issues and forecasts as to where VA is going.

Personally, I like taking the time to think through next steps in my own law practice and to meet up with some of my buddies from previous meetings. The Bar of attorneys practicing in this area of law is rather small, and the group as a whole becomes a group of distant friends over the years.

My big plan over the next two days before the conference starts is to meet with some officials and take a lot of “b-roll” with my camera. Should be good times.

  1. Had a hearing on my RBA Dispute on Monday. Received a Clerk’s Order saying that “we had agreed the dispute was resolved.”

    Now I have to file an NOA to the 10th because the dispute is not resolved. The attorneys did not indicate they were medically trained or knowledgeable about TBI residuals and an appeal to increase, saying seizure residuals diagnosed (erroneously) as pseudo seizures were not relevant residuals of a TBI.

    How are the attorneys getting around these road blocks against getting evidence from the Health Division to the Benefits Compensation Adjudication Section and entered into the C&P file?

A returning Desert Storm Veteran in 1991, and still active, and years before the government recognized hundreds of thousands veteran returning from Iraq illnesses “could” be related to nerve gas exposure and other “cocktails” of toxin National Organization Veteran Advocate ( NOVA ) representative from Providence RI, Robert Chisholm, met with our organization, Persian Gulf Veterans of Rhode Island (196), and communicated to Desert Storm Veterans,
    “……be prepared for years of denial by our government. Moreover, as the Vietnam Veterans fought for years due to agent orange, Desert Storm Veterans will fight for years, many going to their graves without the government recognizing their illness and death was related to serving their country”

    Fast forward 27 years-2018, NOVA communications to Desert Storm Veterans in 1997, so true and factual. My original claim filed in 1997 by the DAV, remains active appeal—and numerous appeals from NOVA, I am over 100 percent( 80 % compensated).

    Those who think of NOVA lawyers doing it just for the money lack the knowledge of decisions won by NOVA attorneys impact only help the Veteran NOVA represented, but thousands of Veteran filing claims afterward. Layman, a decision that will be authority for raters to approve a Veterans claims.

    Yes, NOVA lawyers are allowed to the percentage of retroactive benefits won on appeal. However, the amount is reviewed and approved by VA prior to being released to NOVA.

    Could the DAV, VFW have represented me thin my appeals, yes, but not the same; NOVA is still appealing my 1997 claim, which started at ZERO, and now is 80 percent as a result of successful NOVA appeals, including over $100, 000 of retroactive.

    However, I know more than highly unlikely one of the service officers from one of the major Veteran organization would have represented to recoup attorney fees withheld on my claim, Cianci vs MacDonald , Vet App No. 15-0923 , United States Courts of Appeals For Veteran Claims, resulting in VA agreeing to reimburse me almost $10,000 in attorney fees.

    In closing, NOVA representatives, major veteran organizations( VFW, American Legion, DAV, AMVETS, Italian Americans War Veterans, etc…), private attorneys, and political leaders all are instrumental in ensuring our government provides needed and entitled to Veterans who have served. All provide assistance to Veterans in navigating a very complicated legal —yes legal —— system a Veteran enters into when he or she applies for Veteran benefits, which can only be approved in accordance with applicable laws and regulations.

    Between 2010-2012 Reuter’s and even the A.P. have been corrupted. It seems that the options for objective report of any kind is almost gone.

    What do most American lawyers and doctor’s have in common??
    Well now, it’s funny you should ask that!
    Both are getting shafted in the reimbursement department for their services on behalf of Veterans by Congress critters and their sham laws, and shafted by the VA, when ever it comes to veterans getting a square deal, a fair deal, or any kind of “beneficial for the veteran” deal at all…
    Lawyers get shafted because of a long lost civil war era law still on the books governing lawyer reimbursement for services to veterans, which basically makes it Not financially worth it to help veterans, so instead they chase ambulances, easy cases, etc., etal…???
    It’s not small wonder why there are so few veterans attorneys: there is little money in it, and in this day and age of greed and power lust, good frigging luck finding a lawyer to help you if you are a veteran in need of legal assistance.
    Civilian doctors outside VA get shafted when being paid by VA reimbursements, if they get reimbursed, or wHen they do get reimbursed, they are only getting 80% of what Medicare pays to take care of vets. How much interest would you take in a complex patient if you knew you could choose easier patients and get paid more?
    Moral of this story is simple:
    If you could do the same work, but have a choice which type clients too work for, would you choose to work for peanuts, or would you go where the Platinum is???

    Why don’t you ask him why his aides call veterans “LIARS”, when they call to inform him of corruption, waste, fraud and abuse going on in the different VHA’s in Central Florida?

  10. There are more than 500 lawyers in America??? Wow. I should have thought ten per state was enough… When did this happen? It must have taken place when the great minds of science demoted Pluto to a rock and not a planet, and we elected Trump to follow on Obama…

    Bring along a jar filled with angry bees for your “b-roll” footage to ensure true colors are displayed by “officials” when you call them on their own can of worms. Maybe disguise the jar of angry bees to look like the classic can of trick canned nuts that when opened a springy snake flies out, but in this case, angry bees…getting congress critters on Veteran’s Committees to display true colors can be SO MUCH FUN, considering those Stairmasters are stationary…… 🙂
